Takes note of the agreement reached in June 2014 between SOCO International and the conservation group WWF, in relation to WWF’s complaint to the UK National Contact Point (NCP) on SOCO’s lack of compliance with the OECD Guidelines for Multinational Enterprises, according to which the company commits not to undertake or commission any exploratory or other drilling within Virunga National Park unless UNESCO and the DRC Government agree that such activities are not incompatible with its World Heritage Status; notes that such conditional agreement offers no guarantees as to the cessation of any oil-related activity in the park; points out that the ambiguous position of SOCO International leaves the door open to the park being fully or partially declassified for oil drilling; observes that the concession that SOCO has been exploring is located in and around Lake Edward, an area which is home to dozens of iconic (and some endangered) species, including chimpanzees, elephants, crocodiles and lions; calls, therefore, on SOCO International plc and its DRC-registered company to stop all exploration and exploitation within Virunga permanently and to respect the park’s current boundaries; calls also on the DRC Government to cancel the oil exploration permits granted within the property of Virunga National Park, as requested by the World Heritage Committee;

A. considérant que le parc national des Virunga, situé dans la province du Nord-Kivu et la province orientale de la RDC, à la frontière du Rwanda et de l'Ouganda, est le parc national le plus ancien d'Afrique, classé au patrimoine mondial et mondialement connu pour ses habitats uniques et la richesse de sa biodiversité, inégalée en Afrique; que le parc est notamment connu pour ses gorilles de montagne, espèce gravement menacée inscrite à l'annexe I de la convention sur le commerce international des espèces de faune ou de flore menacées d'extinction (CITES), signée en 1973;
A. whereas the VNP, located in the Provinces of North-Kivu and ‘Province Orientale’ of the DRC on the border with Rwanda and Uganda, is Africa’s oldest national park and a UNESCO World Heritage Site, and is globally renowned for its unique habitats and rich biodiversity, making it the most biodiverse park in Africa; whereas the park is, in particular, renowned for its mountain gorillas, a critically endangered species listed in Appendix I of the 1973 Convention on International Trade in Endangered Species (CITES);

14. invite le Service européen pour l'action extérieure à élaborer une réponse diplomatique coordonnée des États membres de l'Union et d'autres bailleurs de fonds potentiels actifs en RDC, afin d'aider le gouvernement congolais à renoncer à l'exploration et à l'exploitation pétrolières dans le parc national des Virunga, à annuler les permis de prospection pétrolière portant sur des zones entrant dans le périmètre du parc national des Virunga, ainsi que le réclame le Comité du patrimoine mondial, ainsi que dans d'autres sites du Congo classés au patrimoine mondial de l'Unesco, et à rejeter les modifications des limites du parc et la réduction de sa superficie;

Calls on the European External Action Service to coordinate a diplomatic response from the EU Member States and other potential donors active in the DRC, with a view to helping the DRC Government reject oil exploration and exploitation within the boundaries of the park, cancel the oil exploration permits granted within the property of the VNP, as requested by the World Heritage Committee, and in the other Congolese UNESCO World Heritage Sites, and to reject changes to, and the reduction of, the park’s boundaries;

2. Deplores the fact that the VNP has also become one of the most dangerous places in the world when it comes to wildlife conservation; notes with deep concern that armed groups have been involved in illegal exploitation of the park’s natural resources through mining activities and charcoal production used both to sustain their military operations and for personal gain; deplores, also, the fact that armed groups have been involved in large-scale poaching for food purposes and for war-sustaining trade in ivory and bush meat; notes with concern, furthermore, that poor discipline, irregular pay and lack of food have resulted in military personnel becoming increasingly involved in illegal activities, including artisanal mining, charcoal production and wildlife poaching; notes that while the park is an area of great wilderness, its two million acres (790 000 hectares) have huge protection problems, especially with limited government funding; notes that on 15 April 2014 the Chief Warden of the Park, Belgian Prince Emmanuel de Merode, was seriously injured by three gunmen and that more than 140 rangers have been killed in the park on active service in the past decade;

Therefore, the Commission concludes that the different trade exposure levels for sand and asphalt by comparison with the other types of aggregates are not relevant for its assessment as firstly, sand and asphalt are taken together, whereas they are in different product markets, sand belonging to the first category of crushed rock aggregate and asphalt being a processed aggregate, and, secondly, the figures are influenced by imports trends, probably relating to asphalt.

The Greek authorities reiterated their main argument that, in line with the Combus judgment, the contribution of the Greek State to the costs of the VRS does not confer any economic advantage on OTE, first because the contribution does not mitigate the normal employment-related budgetary burdens of OTE, and second because it covers solely the removal of a structural disadvantage of a former public undertaking.

The Commission has doubts about the reliability of the market share estimates that had been submitted by Germany and adjusted downwards, first because similar reporting problems in individual cases may also affect the other competitors but may not have been taken into account in the market volumes given, and second because third parties which submitted comments in the course of the proceedings and were asked for their own estimates more or less confirmed the original figures.
