En premier lieu, demande d’annulation partielle de la décision C(2005) 4012 final de la Commission, du 20 octobre 2005, relative à une procédure d’application de l’article 81, paragraphe 1, [CE] (Affaire COMP/C.38.281/B.2 — Tabac brut — Italie), en deuxième lieu, demande de réduction du montant de l’amende infligée à Transcatab par cette décision et, en troisième lieu, demande reconventionnelle de la Commission tendant à l’augmentation dudit montant.
APPLICATION (i) for partial annulment of Commission Decision C(2005) 4012 final of 20 October 2005 relating to a proceeding under Article 81(1) [EC] (Case COMP/C.38.281/B.2 — Raw tobacco — Italy); (ii) for a reduction in the fine imposed on Transcatab by that decision; and (iii) by way of counterclaim by the Commission, for the amount of that fine to be increased.

4. Dans le cas des amendes, lorsque le débiteur constitue une garantie financière acceptée par le comptable en lieu et place d’un paiement, le taux d’intérêt applicable à compter de la date limite visée à l’article 80, paragraphe 3, point b), est le taux visé au paragraphe 2 du présent article qui est en vigueur le premier jour du mois au cours duquel a été arrêtée la décision imposant une amende, majoré seulement d’un point et demi de pourcentage.
4. In the case of fines, where the debtor provides a financial guarantee which is accepted by the accounting officer instead of payment, the interest rate applicable from the deadline referred to in Article 80(3)(b) shall be the rate referred to in paragraph 2 of this Article as in force on the first day of the month in which the decision imposing a fine has been adopted and increased only by one and a half percentage points.

In order for the Commission to be able to assess in due time the implementability of amendments envisaged by the budgetary authority which create new preparatory actions/pilot projects or prolong existing ones, both arms of the budgetary authority will inform the Commission by mid-June of their intentions in this regard, so that a first discussion may already take place at the conciliation meeting of the Council's first reading.
