In the first place, the Commission observes that a rational market operator would have taken into consideration whether it would be more economically rational to liquidate the company or to provide additional capital, bearing in mind the poor financial performance of ENVC between 2000 and 2006 and considering as well the measures already granted by the State to ENVC before the 2006 capital increase (i.e. one of the DGTF loans for an amount of EUR 30 million granted in January/February 2006, the shipbuilding subsidies in excess of EUR 27 million and the professional training subsidies).

Thus, the Civil Service Tribunal disregarded, in the first place, the case-law according to which the statement of reasons for the decision rejecting a complaint is deemed to supplement the statement of reasons for the decision against which the complaint was directed (see, to that effect, Case T-562/93 Obst v Commission [1995] ECR-SC I-A-247 and II-737, paragraph 79, and Case T-71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I-A-339 and II-921, paragraph 79), in the second place, the principle of legality, according to which the reasons for a decision may be based only on factors which predate or are contemporaneous with it, and, in the third place, the purpose of the pre-litigation procedure consisting in giving the parties the possibility of finding an amicable solution to the dispute (Case T-86/98 Gouloussis v Commission [2000] ECR-SC I-A-5 and II-23, paragraph 61).

In the assessment of the existence of an advantage, the Commission will first demonstrate that the measure could not be obtained from the rest of the market. Secondly, it will demonstrate that SACE did not act as a private reinsurer. Third, it will demonstrate that even when one takes into account the fact that SACE was the parent company of SACE BT, this does not allow to conclude that SACE acted as a private company in such a situation would have done. Fourth, the Commission will demonstrate that the reinsurance provided by SACE provides an advantage to SACE BT.

As regards the first measure, the Commission first clarified that the qualification of aid could be excluded from the initial capital endowment if it was provided to non-marketable risks and/or if it was simply the transfer to SACE BT of capital that had already been allocated to short-term insurance activity that existed before within SACE (including to previously non-marketable risks turned into marketable risks on 1 May 2004).

En troisième lieu, ne sauraient prospérer non plus les arguments avancés par le requérant à l’appui de sa thèse, selon laquelle il aurait dû être classé à un grade plus élevé, à savoir, premièrement, que le poste qu’il occupait en tant qu’expert national détaché était considéré comme « sensible » au vu de sa fiche de poste en raison des compétences particulières requises, ses fonctions étant restées strictement identiques lorsqu’il a été nommé agent temporaire de grade AD 5 ; deuxièmement, qu’en décembre 2012 cette fiche de poste coïncidait avec celles de deux autres membres de la même équipe, lesquels étaient des fonctionnaires, l’un classé au grade AD 12 et l’autre au grade AD 13 ; et, troisièmement, qu’il aurait été engagé comme agent temporaire et classé au grade AD 5, alors que son prédécesseur était un fonctionnaire de grade AD 13.
Thirdly, nor is it possible to accept the applicant’s arguments that he should have been recruited at a higher grade because, first, the post he occupied as a seconded national expert was regarded as ‘sensitive’ in the light of his job description, due to the particular skills required, and his functions remained exactly the same when he was appointed as a temporary agent in grade AD 5; secondly, because in December 2012 his job description was the same as those of the two other members of the same team who were officials, one in grade AD 12 and the other in grade AD 13; and, thirdly, because he was engaged as a temporary agent and recruited at grade AD 5, whilst his predecessor had been an official in grade AD 13.

First, the Court of First Instance erred in law in holding, in paragraphs 83 and 84 of the judgment under appeal, that the figures relating to sales of the products covered by the mark applied for and the advertising costs incurred in promoting the mark do not establish that the mark has acquired distinctive character through the use which has been made of it, in the absence of information relating to the share of the confectionery market and the share of the amount of publicity for the market to which those figures relate, respectively.
