D’autre part, il n’apparaît pas non plus que l’adoption de la décision 2009/62 ait eu pour conséquence de mettre un terme au litige entre les parties et que, dès lors, le pourvoi soit devenu sans objet pour ce motif (voir par analogie, notamment, ordonnance du 1 décembre 2004, OHMI/Zapf Creation, C‑498/01 P, Rec. p. I‑11349, point 12).
Nor, secondly, does it appear that, as a consequence of the adoption of Decision 2009/62, the dispute between the parties has been brought to and end and that the appeal has therefore become devoid of purpose for that reason (see, by analogy, the order of 1 December 2004 in Case C‑498/01 P OHIM v Zapf Creation [2004] ECR I‑11349, paragraph 12).
