Pour le faire, il devra prouver que le délinquant démontre une indifférence marquée quant aux conséquences de ses actes(149), que son comportement est si brutal qu’il ne peut être maîtrisé(150) ou, encore, que le délinquant est incapable de contrôler ses actes ou ses impulsions sexuelles et qu’il causera, vraisemblablement(151), la mort ou d’autres sévices s’il n’est pas incarcéré préventivement(152).
Second, after proving that the underlying offence constitutes a serious personal injury offence, the prosecutor must show that the offender represents a risk to society (148) To do that, the prosecutor must prove that the offender demonstrates a marked indifference to the consequences of his or her actions,(149) that his or her behaviour is so brutal that it cannot be controlled,(150) or that the offender is incapable of controlling his or her actions or sexual impulses and will in all probability(151) cause death or other serious injury if he or she is not put in preventive detention (152)
