C'est pourquoi la consultation publique vise à recueillir des avis sur la possible existence d'une lacune dans la mise en œuvre du contrôle des concentrations dans l'UE, en ce sens que ce contrôle ne couvrirait pas certains types d'opérations transfrontières qui sont susceptibles d'avoir une incidence sur la concurrence au sein du marché unique de l'UE ou dans une partie importante de celui-ci.
Therefore, the public consultation seeks views on whether there is a possible enforcement gap under EU merger control, in that it may not cover certain types of cross-border transactions that may potentially have an impact on competition in the EU's Single Market or in a substantial part of it.

Recalls that the IPOA-Capacity (International Plan of Action for the Management of Fishing Capacity) committed the EU, no later than 2005, to develop and implement a system for the management of fishing capacity; requests the Commission to explain why it appears to be pursuing contradictory approaches to the management of capacity by proposing a freeze in certain RFMOs while proposing to remove the main regulatory limits to capacity within the EU’s fleets; requests the Commission to promote bilateral and multilateral mechanisms for the adjustment of fishing capacity to the available resources, which are identified as necessary for the sustainable exploitation of resources by all fleets that operate in these areas;

Or c'est précisément cette dernière condition qui explique généralement pourquoi certaines opérations ne remplissent pas les critères de l'article 1er, paragraphe 3, ce qui a pour effet d'obliger les parties à notifier leur projet dans au moins trois États membres.
The latter requirement, in particular, appears to be one of the most common reasons why multiple filing cases fail to meet the criteria in Article 1(3), often with the result that notifications in three or more Member States are required.

(24) In view of the speed with which modern fully automated payment systems process payment transactions, which means that after a certain point payment orders cannot be revoked without high manual intervention costs, it is necessary to specify a clear deadline for revocations, in order to allow efficient processing while ensuring legal certainty for all the parties involved.
