Fourthly and lastly, it is not possible to accept the applicant’s arguments that the contested grading decision is unlawful, that is to say, first, that the vacancy notice allowed officials in a range of grades from grade AD 5 to grade AD 14 to apply for the post and, secondly, that officials who were working, or had worked, in the same service as the applicant and had presumably performed the same functions, were in a higher grade than the one at which the applicant was recruited.
