En outre, une telle situation réduirait les possibilités de limiter ou de refuser l’accès à certains droits.
If uniformity were to be understood as meaning a higher degree of harmonisation, this option would result in one uniform status for refugees and another for beneficiaries of subsidiary protection. This would mean reducing the flexibility allowed by the current legal framework regarding the content and duration of the rights to be granted as well as the possibility to limit or refuse access to certain rights.

Moreover, the procedure in which an application for international protection is examined should normally provide an applicant at least with: the right to stay pending a decision by the determining authority; access to the services of an interpreter for submitting his or her case if interviewed by the authorities; the opportunity to communicate with a representative of the United Nations High Commissioner for Refugees (UNHCR) and with organisations providing advice or counselling to applicants for international protection; the right to appropriate notification of a decision and of the reasons for that decision in fact and in law; the opportunity to consult a legal adviser or other counsellor; the right to be informed of his or her legal position at decisive moments in the course of the procedure, in a language which he or she understands or is reasonably supposed to understand; and, in the case of a negative decision, the right to an effective remedy before a court or a tribunal.

Tout d’abord, en tant que rapporteur permanent sur les questions de contrôle de la subsidiarité et de la proportionnalité, je peux vous dire qu’il est absolument fondamental que nos parlements nationaux jouent le rôle qui leur incombe dans notre processus législatif, mais faute d’adéquates possibilités d’interprétation, cette part de notre travail n’est pas réalisée au mieux de nos capacités.

In addition, it must be stated that the interpretation proposed by the Parliament, according to which Article 27(4) of the Rules Governing the Payment of Expenses and Allowances gives the institution the possibility of suspending, wholly or partially, the payment of the allowances owed to a Member until the latter repays of his own volition the amounts improperly received, without using for that purpose the amounts of the allowances due to him but the payment of which has been suspended, contravenes the principle of proportionality.
