52. rappelle qu'il soutient vivement la Cour pénale internationale, dont l'objectif principal est la lutte contre l'impunité en cas de génocide, de crimes de guerre et de crimes contre l'humanité; accueille avec satisfaction les ratifications du Statut de Rome par le Bangladesh, les Seychelles, Sainte-Lucie et la Moldavie en mars, août et octobre 2010, qui portent à 114 le nombre total des États parties; souligne que le Statut de Rome de la CPI a été ratifié par tous les États membres de l'Union européenne et qu'ils le considèrent comme une composante essentielle des principes démocratiques et des valeurs de l'Union, et invite dès lors les États membres à respecter pleinement le Statut en tant que partie intégrante de l'acquis de l'Union; souligne l'importance du principe d'universalité et invite le SEAE, les États membres de l'Union et la Commission à poursuivre leurs efforts résolus pour promouvoir la ratification universelle du Statut de Rome et l'accord sur les privilèges et les immunités de la CPI, ainsi que l'adoption des dispositions législatives d'application nécessaires au niveau national, et à revoir la position commune 2003/444/PESC du 16 juin 2003 concernant la Cour pénale internationale et le plan d'action de 2004 pour assurer le suivi de cette position commune; demande que ces efforts concernent aussi l'accord sur les privilèges et les immunités de la CPI, qui est un outil opérationnel important pour la Cour; invite également les États membres de l'Union à réviser et mettre à jour la position commune et le plan d'action sur la CPI, afin de renforcer l'aide effective de l'Union à la Cour à la lumière des évolutions actuelles, des défis et des besoins de la Cour, eu égard à la multiplication du nombre de ses mandats d'arrêt et de ses procès, ainsi qu'à engager des discussions sur l'adoption éventuelle de lignes directrices de l'Union sur la justice internationale et la CPI;
52. Reiterates its strong support for the International Criminal Court and its primary objective of fighting impunity for genocide, war crimes and crimes against humanity; welcomes the fact that the ratifications of the Rome Statute by Bangladesh, the Seychelles, Saint Lucia and Moldova in March, August and October 2010 brought the total number of States Parties to 114; stresses that the Rome Statute of the ICC was ratified by all the EU Member States as an essential component of the democratic principles and values of the Union and therefore calls upon the Member States to comply fully with the Statute as part of the EU acquis; underlines the importance of the principle of universality, and calls on the EEAS, the EU Member States and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and the agreement on Privileges and Immunities of the International Criminal Court and national implementing legislation, and to review the Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court and the 2004 Action Plan to follow up on the Common Position; requests that such efforts be extended to the Agreement on the Privileges and Immunities of the ICC (APIC), an important operational tool for the Court; further calls on EU Member States to revise and update the Common Position and Action Plan on the ICC in order to reinforce effective assistance by the EU of the ICC in light of current developments, challenges and needs of the Court, as the warrants for arrest and trials at the ICC continue to increase in number, as well as to start discussions on the possible adoption of EU guidelines on international justice/ ICC;

17. invite le Conseil et la Commission à poursuivre leurs efforts vigoureux pour promouvoir la ratification universelle du Statut de Rome et l'adoption des dispositions législatives d'application nécessaires au niveau national, conformément à la position commune 2003/444/PESC du 16 juin 2003 concernant la Cour pénale internationale et au Plan d'action de 2004 pour assurer le suivi de la position commune; demande que ces efforts aboutissent à la ratification et à la mise en œuvre de l'accord sur les privilèges et les immunités de la CPI, qui est un outil opérationnel important pour la Cour; accueille avec satisfaction les récentes ratifications du Statut de Rome par Madagascar, les îles Cook et le Suriname en 2008, qui portent à 108 le nombre total des États parties en juillet 2008; invite la République tchèque, dernier État membre de l'Union à ne pas avoir ratifié le statut de Rome, à enfin remédier sans plus tarder à cette situation ; invite instamment la Roumanie à abroger l'accord bilatéral d'immunité qui la lie aux États-Unis d'Amérique;

Le plan d'action demandé, entre autres, par une résolution sur l'entrée en vigueur du statut de la Cour pénale internationale approuvée par le Parlement européen le 28 février 2002 pour assurer le suivi de la position commune 2001/443/PESC du Conseil du 11 juin 2001 concernant la Cour pénale internationale (2), a été adopté le 4 février 2004 et devrait le cas échéant être adapté.
The Action Plan which was, inter alia, called for by a Resolution on entry into force of the Statute of the International Criminal Court approved by the European Parliament on 28 February 2002 to follow up Council Common Position 2001/443/CFSP of 11 June 2001 on the International Criminal Court (2) was adopted on 4 February 2004 and should be adapted as appropriate.

Calls on the Council and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and the adoption of the requisite national implementing legislation, in conformity with Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court (19) and the Action Plan; points out that not all Council presidencies pursue this common goal with the same vigour; asks all presidencies to mention the status of the ICC cooperation in all summits with third countries; requests that such efforts be extended to include ratification and implementation of the Agreement on the Privileges and Immunities of the ICC, which is an important operational tool for the ICC; notes the entry into force on 8 December 2007 of the agreement with the United Kingdom on the enforcement of sentences (and the entry into force of a similar agreement concluded with Austria in 2005), and urges all Member States to consider concluding similar agreements with the ICC; acknowledges the Cooperation and Assistance Agreement between the European Union and the ICC as an important tool to supplement the obligations incumbent on individual Member States;
