La Commission estime notamment que le gouvernement polonais a empiété sur sa compétence exclusive en exigeant de la banque italienne Unicredito qu’elle vende ses parts détenues dans la banque polonaise BPH, bien que la Commission ait déjà autorisé, le 18 octobre 2005 (voir IP/05/1299), l’acquisition de BPH par Unicredito dans le cadre de sa reprise de la banque allemande HVB.
In particular, the Commission considers that the Polish Government has encroached on the Commission’s exclusive competence by requiring Italian bank Unicredit to divest its shares in Polish bank BPH, despite the fact that the Commission already authorised, on 18th October 2005 (see IP/05/1299), Unicredit’s acquisition of BPH as part of its takeover of German bank HVB.
