In 2005, the Committee, in its role as a management committee, was consulted on the amendment of Regulation (EC) No 1681/94 concerning irregularities and recovery of sums wrongly paid in connection with the financing of structural policies and the organisation of an information system in this field.

In 2005, the Committee was consulted on the following issues: FIFG technical assistance for 2005; draft Commission decision on project No I/0016/90/02 – Azienda Agricola LE CANNE; preparation of Community Guidelines for State Aids for rescue and restructuring of firms in the fisheries sector; draft Commission Regulation amending Commission Regulation (EC) No 1681/94 concerning irregularities and the recovery of sums wrongly paid in connection with financing of the structural policies and the organisation of an information system in this field.

Reminds the Commission that the European Parliament in its resolution of 29 November 2001 , called upon it to provide, by 15 December 2001, a list of all the irregularities communicated since the entry into force of the Commission Regulation (EC) No 1681/94 of 11 July 1994 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the structural policies and the organisation of an information system in this field showing in each case the size of the financial loss and whether, and to what extent, monies had been recovered;

Reminds the Commission that it had been called upon to provide Parliament, by 15 December 2001, with a list of all the irregularities communicated since the entry into force of the Regulation (EC) No 1681/94 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the structural policies and the organisation of an information system in this field showing in each case the size of the financial loss and whether and to what extent monies had been recovered;

Toutefois, il est important de rappeler que l'article 3 § 1 du Règlement (CE) n° 1681/94 de la Commission du 11 juillet 1994 concernant les irrégularités et le recouvrement des sommes indûment versées dans le cadre du financement des politiques structurelles ainsi que l'organisation d'un système d'information dans ce domaine dispose que : "au cours des deux mois qui suivent la fin de chaque trimestre, les États membres communiquent à la Commission un état indiquant les cas d'irrégularités qui ont fait l'objet d'un premier acte de constat administratif ou judiciaire".
It is important to reiterate, however, that Article 3(1) of Commission Regulation (EC) No 1681/94 of 11 July 1994 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the structural policies and the organisation of an information system in this field stipulates that ‘during the two months following the end of each quarter, Member States shall report to the Commission any irregularities which have been the subject of initial administrative or judicial investigations’.
