Les modifications concernent les points suivants: la définition d’« irrégularité » visée à l’article 1, paragraphe 2 du règlement (CE) n° 2988/95 du Conseil, la définition de « soupçon de fraude », la clarification du moment où il convient de notifier un cas, la définition de « faillite » et la dérogation à l’obligation de notifier les cas de faillite, sauf dans certaines circonstances, à savoir en cas de soupçon de fraude, la transmission par voie électronique des informations relatives aux cas d’irrégularités, l’élévation du seuil de notification à 10 000 € au lieu de 4 000 € et la redéfinition des objectifs, en insistant sur l’analyse des risques.
The amendments concern: the definition of irregularity as stated in Article 1.2 of Regulation (CE) n° 2988/95 of the Council; the definition of suspicion of fraud; the clarification of the moment when a case must be notified; the definition of “bankruptcy” and the exclusion of the obligation to notify cases of bankruptcy, except some cases, namely when there is a suspicion of fraud; the electronic transmission of irregularity cases; the increase of the notification threshold from€ 4 000 to € 10 000; the redefinition of the objectives, stressing on risk analysis.
