Member States and managing authorities may withdraw contributions from programmes to the financial instruments referred to in point (a) of Article 38(1) and financial instruments referred to in point (b) of Article 38(1) implemented in accordance with points (a) and (b) of Article 38(4) of Regulation (EU) No 1303/2013 only if the contributions have not already been included in an application for payment as referred to in Article 41 of that Regulation.

1. En ce qui concerne les instruments financiers visés à l'article 38, paragraphe 1, point a) et les instruments financiers visés à l'article 38, paragraphe 1, point b), mis en œuvre conformément à l'article 38, paragraphe 4, points a) et b), les contributions au titre d'un programme à un instrument financier durant la période d'éligibilité prévue à l'article 65, paragraphe 2 (ci-après dénommée "période d'éligibilité") font l'objet de demandes échelonnées de paiements intermédiaires, aux conditions suivantes:

The first two subparagraphs are replaced by the following:" The Commission shall, by means of implementing acts pursuant to Article 38b(f), in accordance with the criteria to be adopted by means of delegated acts pursuant to Article 38a(1)(c)(v), recognise the control authorities and control bodies referred to in paragraph 1(b) of this Article, including control authorities and control bodies as referred to in Article 27, which are competent to carry out controls and to issue the documentary evidence referred to in paragraph 1(c) of this Article in third countries.

Article 7b is replaced by the following:" Article 7b Exceptional and critical circumstances Where exceptional and critical circumstances arise within the meaning of Article 24(4)(b) and Article 25(4) of the Interim Agreement, and thereafter Article 37(4)(b) and Article 38(4) of the Stabilisation and Association Agreement, the Commission may take immediate measures as provided for in Articles 24 and 25 of the Interim Agreement, and thereafter Articles 37 and 38 of the Stabilisation and Association Agreement, in accordance with the advisory procedure referred to in Article 7a(3a) Article 7fa(4) of this Regulation.

Il faut cependant assurer que cela se fasse sans préjudice des décisions de la Commission 93/676/CEE du 10 décembre 1993 constatant que l'exploitation d'aires géographiques dans le but de prospecter ou d'extraire du pétrole ou du gaz ne constitue pas aux Pays-Bas une activité visée à l'article 2, paragraphe 2, point b), i), de la directive 90/531/CEE du Conseil et que les entités exerçant cette activité ne sont pas considérées aux Pays-Bas comme bénéficiant de droits spéciaux ou exclusifs au sens de l'article 2, paragraphe 3, point b), de cette directive et 97/367/CE du 30 mai 1997 constatant que l'exploitation d'aires géographiques dans le but de prospecter ou d'extraire du pétrole ou du gaz ne constitue pas au Royaume-Uni une activité visée à l'article 2, paragraphe 2, point b), i), de la directive 93/38/CEE du Conseil, et que les entités exerçant cette activité ne sont pas considérées au Royaume-Uni comme bénéficiant de droits spéciaux ou exclusifs au sens de l'article 2, paragraphe 3, point b), de cette directive .
It has to be ensured, however, that this will be without prejudice to Commission Decisions 93/676/EEC of 10 December 1993 establishing that the exploitation of geographical areas for the purpose of exploring for or extracting oil or gas does not constitute in the Netherlands an activity defined by Article 2(2)(b)(i) of Council Directive 90/531/EEC and that entities carrying on such an activity are not to be considered in the Netherlands as operating under special or exclusive rights within the meaning of Article 2(3)(b) of the Directive and 97/367/EC of 30 May 1997 establishing that the exploitation of geographical areas for the purpose of exploring for or extracting oil or gas does not constitute in the United Kingdom an activity defined by Article 2(2)(b)(i) of Council Directive 93/38/EEC and that entities carrying on such an activity are not to be considered in the United Kingdom as operating under special or exclusive rights within the meaning of Article 2(3)(b) of the Directive .
