BW. whereas, despite the fact that the laws were amended in 2011 following negotiations with the European Commission and in May 2012 further to the decision of the Constitutional Court of December 2011 overturning several provisions as unconstitutional regarding the content regulation of the printed press, the protection of the sources of journalists, the requirement of data provision, and the institution of the Media and Telecommunications Commissioner, the OSCE Representative on freedom of the Media has deplored the fact that several amendments were introduced and adopted at short notice without consulting stakeholders and that fundamental elements in the legislation have not been improved, notably the appointment of the president and members of the Media Authority and Media Council, their power over content in the broadcast media, the imposition of high fines and the lack of safeguards on the financial and editorial independence of public broadcasters;

Expresses its concern that several Member States have not transposed correctly the provisions of Framework Decision 2008/913/JHA and calls on the Member States to fully transpose and implement EU standards and to ensure the enforcement of national legislation punishing all forms of hate crime, incitement to hatred and harassment, and systematically triggering the prosecution of those criminal offences; calls on the Commission to monitor the correct transposition of the Framework Decision and to launch infringement procedures against those Member States that fail to transpose it; calls, furthermore for a review of the framework decision in order for it to fully cover all forms of hate crime and crimes committed with a bias or discriminatory motive, and to clearly define consistent investigation and prosecution standards;

Si les erreurs de droit ou de fait visées au paragraphe 1 résultent d’une transmission entachée d’erreur ou d’un manquement aux obligations prévues par la présente décision de la part d’un ou de plusieurs États membres ou d’un stockage ou traitement illicite ou incorrect de la part d’Europol, Europol ou cet (ces) État(s) membre(s) sont tenus au remboursement, sur demande, des sommes versées à titre d’indemnisation en vertu du paragraphe 1, à moins que ces données n’aient été utilisées par l’État membre sur le territoire duquel le fait dommageable a été commis, en violation de la présente décision.
2. If the legal or factual errors referred to in paragraph 1 occurred as a result of the erroneous communication of data or of failure to comply with the obligations laid down in this Decision on the part of one or more Member States or as a result of unauthorised or incorrect storage or processing by Europol, Europol or the other Member State in question shall be bound to reimburse, on request, for the amounts paid as compensation pursuant to paragraph 1 unless the data were used in breach of this Decision by the Member State in the territory of which the damage was caused.

(15) Il devrait être considéré qu'il y a circonstance extraordinaire, lorsqu'une décision relative à la gestion du trafic aérien concernant un avion précis pour une journée précise génère un retard important, un retard jusqu'au lendemain ou l'annulation d'un ou de plusieurs vols de cet avion, bien que toutes les mesures raisonnables aient été prises par le transporteur aérien afin d'éviter ces retards ou annulations.
(15) Extraordinary circumstances should be deemed to exist where the impact of an air traffic management decision in relation to a particular aircraft on a particular day gives rise to a long delay, an overnight delay, or the cancellation of one or more flights by that aircraft, even though all reasonable measures had been taken by the air carrier concerned to avoid the delays or cancellations.
