Le mécanisme mis en place par la présente décision-cadre vise notamment à faire en sorte qu'une personne qui a été condamnée pour une infraction sexuelle commise à l'égard d'enfants ne soit plus en mesure, lorsque son casier judiciaire dans l'État membre de condamnation comporte ce type de condamnation et, le cas échéant, une déchéance consécutive inscrite dans le casier judiciaire, de dissimuler cette condamnation ou déchéance afin d'exercer une activité professionnelle liée à la surveillance d'enfants dans un autre État membre.
The mechanism established by this Framework Decision aims at inter alia ensuring that a person convicted of a sexual offence against children should no longer, where the criminal record of that person in the convicting Member State contains such conviction and, if imposed and entered in the criminal record, a disqualification arising from it, be able to conceal this conviction or disqualification with a view to performing professional activity related to supervision of children in another Member State.

[50] 1) Suspension of driving licence; 2) ban on driving certain types of vehicle; 3) cancellation of driving licence; 4) confiscation of one or more vehicles belonging to the offender; 5) immobilisation of one or more vehicles belonging to the offender; 6) ban on possessing or carrying a weapon for which a licence is required for a period of up to five years; 7) confiscation of one or more weapons belonging to the offender or freely available to him; 8) withdrawal of a hunting licence; 9) ban on drawing cheques; 10) confiscation of any object that was used in or intended for use in committing the offence or was the product of the offence; 11) ban on exercising any professional or social activity where the facilities afforded by such an activity were knowingly used to prepare or commit the offence.

En 2006 et 2007, la Commission a présenté un ensemble complet de mesures législatives composé de trois instruments: la décision-cadre 2008/675/JAI du Conseil obligeant les États membres à prendre en compte les décisions de condamnation antérieures à l’occasion d’une nouvelle procédure pénale; la décision-cadre 2009/315/JAI du Conseil concernant l'organisation et le contenu des échanges d'informations extraites des casiers judiciaires; et la décision 2009/316/JAI du Conseil relative à la création de l’ECRIS comme moyen technique d’échanger des informations extraites des casiers judiciaires[47]. Devant être mises en œuvre au plus tard en avril 2012, les décisions-cadres 2009/315/JAI et 2009/316/JAI du Conseil visent à définir les procédures selon lesquelles un État membre prononçant une condamnation doit transmettre les informations relatives à une nouvelle condamnation à l’État membre ou aux États membres de nationalité de la personne condamnée, à préciser les obligations en matière de stockage et à arrêter un cadre pour un système informatisé d’échange d’informations.
In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.
