Par conséquent, le Tribunal, agissant dans l’exercice de sa compétence de pleine juridiction, estime qu’il convient de calculer le montant de l’amende sur la base de la valeur des ventes corrigée à la baisse, en dépit du fait qu’InnoLux avait commis une négligence lorsqu’elle avait fourni à la Commission des données erronées.
Accordingly, the Court, in the exercise of its unlimited jurisdiction, considers it appropriate to calculate the fine on the basis of the lower, corrected, sales value, even though Innolux was negligent when it provided the Commission with inaccurate data.
