Il est rappelé que la Commission a non seulement énoncé clairement sa position générale à l'égard des aides d'État accordées sous la forme de garanties en novembre 1999, mais qu'elle a en outre été saisie, il y a plus d'un an, d'une plainte formelle dirigée spécifiquement contre les deux instruments de garantie traditionnellement utilisés dans le secteur public bancaire allemand (« Anstaltslast » et « Gewährträgerhaftung»).
It is recalled that the Commission not only spelled out its general position as to State aid in the form of guarantees in November 1999 but that it has also received, more than a year ago, a formal complaint directed specifically against « Anstaltslast » and « Gewährträgerhaftung », the two guarantee instruments traditionally used in the German public banking sector.
