That fixed percentage shall be calculated by dividing the national or regional ceiling for the basic payment scheme to be set in accordance with, respectively, Article 22(1) or Article 23(2) of this Regulation for the year 2015, after applying the linear reduction provided for in paragraph 1 or, where applicable, paragraph 2 of Article 30 of this Regulation, by the total value of aid granted under the single area payment scheme in accordance with Regulation (EC) No 73/2009 and under Articles 132 and 133a of that Regulation for 2014 in the Member State or region concerned, before reductions and exclusions provided for in Chapter 4 of Title II of that Regulation.

L’article 69, paragraphe 4, du règlement (CE) no 73/2009 limite les ressources qui peuvent être utilisées pour chacune des mesures couplées prévues à l’article 68, paragraphe 1, points a) i), ii), iii) et iv), et à l’article 68, paragraphe 1, points b) et e), à 3,5 % du plafond national visé à l’article 40 dudit règlement.
Article 69(4) of Regulation (EC) No 73/2009 limits the resources that can be used for any coupled measure provided for in points (i), (ii), (iii) and (iv) of Article 68(1)(a) and in Article 68(1)(b) and (e) to 3,5 % of the national ceiling referred to in Article 40 of the same Regulation.

1b. By way of derogation from paragraph 1a, Member States that during at least one year in the period 2010-2013 allocated more than 10 % of their amount available for granting the direct payments provided for in Titles III, IV and V of this Regulation, with the exception of Section 6 of Chapter 1 of Title IV, to financing the measures laid down in Section 2 of Chapter 2 of Title III of this Regulation, the support provided for in subpoints (i) to (iv) of point (a) and in points (b) and (e) of Article 68(1) of this Regulation, or the measures under Chapter 1, with the exception of Section 6, of Title IV of this Regulation may decide to use more than 13 % of the annual national ceiling set out in Annex VIII of this Regulation subject to approval by the Commission".

3. Par dérogation au paragraphe 2, les États membres ayant attribué, durant une année au moins au cours de la période 2010-2013, plus de 10 % de leur montant disponible pour l’octroi des paiements directs prévus aux titres III, IV et V du règlement (CE) n° 73/2009, à l’exception du titre IV, chapitre 1, section 6, pour financer les mesures établies au titre III, chapitre 2, section 2, du règlement (CE) n° 73/2009, le soutien prévu à l’article 68, paragraphe 1, points a) i) à a) iv), et points b) et e), dudit règlement, ou les mesures relevant du titre IV, chapitre 1, à l’exception de la section 6, dudit règlement peuvent décider d’utiliser plus de 10 % du plafond national annuel fixé à l’annexe II après approbation par la Commission conformément à l’article 41.

By way of derogation from paragraph 2, Member States having allocated during at least one year in the period 2010-2013 more than 10 % of their amount available for granting the direct payments provided for in Titles III, IV and V of Regulation (EC) No 73/2009, with the exception of Section 6 of Chapter 1 of Title IV, for financing the measures laid down in Section 2 of Chapter 2 of Title III of Regulation (EC) No 73/2009, the support provided for in points (i) to (iv) of paragraph 1(a) and paragraphs 1(b) and (e) of Article 68 of that Regulation, or the measures under Chapter 1, with the exception of Section 6, of Title IV of that Regulation may decide to use more than 10 % of the annual national ceiling set out in Annex II upon approval by the Commission in accordance with Article 41.

«Par dérogation au paragraphe 4, durant les années civiles 2010 à 2013, dans le cas où un État membre a accordé un soutien aux vaches allaitantes conformément à l’article 69 du règlement (CE) no 1782/2003 sans appliquer la possibilité prévue à l’article 68, paragraphe 2, point a) i), dudit règlement et a ainsi utilisé plus de 50 % des montants fixés conformément à l’article 69 dudit règlement pour le secteur de la viande bovine, la limite prévue au paragraphe 4 est fixée à 6 % du plafond national dudit État membre visé à l’article 40 du présent règlement.
‘By way of derogation from paragraph 4, during calendar years 2010 to 2013, where a Member State granted support with regard to suckler cows in accordance with Article 69 of Regulation (EC) No 1782/2003 while not having applied the option provided for in Article 68(2)(a)(i) of that Regulation, and in that connection used more than 50 % of the amounts established in accordance with Article 69 of that Regulation for the beef and veal sector, the limit set out in paragraph 4 of this Article shall be set at 6 % of that Member State’s national ceiling referred to in Article 40 of this Regulation.
