Au vu des considérations qui précèdent, d’une part, la Commission ne peut exclure que le 28 décembre 2005, Pickman était encore une entreprise en difficulté, mais, d’autre part, elle considère que Pickman aurait pu, en principe, obtenir un prêt aux conditions du marché sans intervention de l’État, de sorte que le montant de l’aide ne représente pas la totalité du prêt, mais bien l’avantage économique potentiel découlant de la garantie publique elle-même.
In the light of the foregoing, while the Commission cannot rule out that, on 28 December 2005, Pickman still qualified as a firm in difficulty, it nonetheless takes the view that Pickman could, in principle, have obtained a loan on market terms without State intervention. Accordingly, the amount of the aid does not correspond to the total amount of the loan, but rather to the potential economic advantage derived from that State guarantee.

For those reasons, it cannot be ruled out that Pickman was no longer a firm in difficulty when the guarantee was granted.

Par ailleurs, il semble que dans le cas de Pickman: i) il ne soit pas prévu que le plan de restructuration entraîne une augmentation de capacité; ii) les effectifs de l’entreprise seront réorganisés avec des compressions de personnel dans certaines usines et des investissements dans le secteur commercial et informatique; iii) la taille de Pickman soit limitée et puisse bénéficier d’aides; iv) la présence de l’entreprise sur le marché soit très limitée et l’était encore plus en 2003 par rapport à ses concurrents (voir l’étude de marché précitée); et, enfin, v) selon la carte des aides à finalité régionale en Espagne pour la période 2000-2006 (15), l’Andalousie était une région NUTS II et, sur la base de son PIB/EPA par habitant inférieur à 60 % de la moyenne communautaire, elle pouvait se prévaloir des dispositions de l’article 87, paragraphe 3, point a), du traité CE.
Moreover, in the case of Pickman, it appears that (i) the restructuring plan is not expected to lead to an increase in capacity; (ii) the company’s workforce will be reorganised, with downsizing taking place at certain plants and investment being made in the commercial and IT areas; (iii) Pickman is small, meaning that it can avail itself of aid; (iv) the company’s potential presence in the market is very limited and was even more limited in 2003, as compared to its competitors (see the market study referred to above); and (v) according to the Spanish regional aid map for the period 2000-2006 (15), Andalusia was a NUTS II area and, on the basis of its per capita GDP/PPS of below 60 % by comparison with the Community average, qualified under Article 87(3)(a) of the EC Treaty.
