In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into the Union territory; listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into certain protected zones from those third countries; listing of the plants, plant products and other objects, the third countries concerned, and the maximum quantity subject to be exempted from the requirement for a phytosanitary certificate when introduced in the Union territory; and setting out technical arrangements concerning the invalidation of the electronic phytosanitary certificates.

Lorsqu'ils sont en transit phytosanitaire d'un pays tiers vers un autre pays tiers, via le territoire de l'Union, les végétaux, produits végétaux et autres objets sont tenus de respecter les exigences phytosanitaires établies conformément à l'article 40 sans préjudice des autres dispositions phytosanitaires applicables.
Plants, plant products and other objects that are in phytosanitary transit through Union territory from one third country to another are required to satisfy the plant health requirements under Article 40 without prejudice to other applicable plant health rules.

Le présent règlement établit les règles concernant les inspections phytosanitaires et autres mesures officielles des autorités des États membres pour la connaissance du risque phytosanitaire présenté par toute espèce, toute souche ou tout biotype d'agent pathogène, d'animal ou de végétal nuisible aux végétaux ou aux produits végétaux (ci-après dénommé «organisme nuisible»), y compris les plantes exotiques envahissantes nuisibles aux végétaux, et les mesures phytosanitaires nécessaires pour prévenir l'introduction d'organismes nuisibles provenant d'autres États membres ou de pays tiers .
1. This Regulation lays down rules regarding phytosanitary inspections and other official measures by the Member State authorities for the purpose of identifying the phytosanitary risks posed by any species, strain or biotype of pathogenic agents, animals or plants injurious to plants or plant products (hereinafter ‘pests’), including invasive alien plant species which are injurious to plants and phytosanitary measures necessary to prevent the entry of pests from other Member States or third countries.

De plus, si le service juridique fait valoir que la pratique législative associe fréquemment les deux bases juridiques de l'article 37 et de l'article 152 paragraphe 4, point b) et qu'il est souvent difficile d'établir une distinction entre les mesures à caractère purement agricole (vétérinaires ou phytosanitaires) et les mesures agricoles concernant principalement la protection de la santé humaine, il concède que le recours à l'article 37 pour l'adoption de telles mesures est une réminiscence du régime d'avant le traité d'Amsterdam, lorsqu'il n'y avait pas d'article précis du traité concernant les mesures vétérinaires et phytosanitaires et que, parfois, le législateur a utilisé le seul article 152, paragraphe 4, point b) comme base juridique de mesures adoptées pour contrôler une maladie vétérinaire ou phytosanitaire constituant un danger pour la santé humaine.
Again, whereas the Legal Service argues that legislative practice more often than not combines the two legal bases of Article 37 and Article 152(4)(b) and that it is often difficult to distinguish between purely agricultural (veterinary or phytosanitary measures) and agricultural measures aimed principally at protecting legal health, it concedes that the use of Article 37 for the adoption of such measures harks back to the pre-Amsterdam regime when there was no specific Treaty article on veterinary and phytosanitary measures and that in some cases the legislator has used Article 152(4)(b) alone as the legal basis for measures adopted to control a specific animal or plant disease constituting a specific danger to animal health.
