Lorsqu'un végétal, produit végétal ou autre objet originaire ou expédié d'un pays tiers présente un risque phytosanitaire inacceptable parce qu'il est susceptible de porter un organisme de quarantaine de l'Union et que ce risque phytosanitaire ne peut être ramené à un niveau acceptable par l'application de l'une ou plusieurs des mesures énumérées à l'annexe II, section 1, points 2) et 3), la Commission modifie l'acte d'exécution prévu au paragraphe 2 en conséquence pour y inclure ledit végétal, produit végétal ou autre objet ainsi que les pays tiers, les groupes de pays tiers ou les zones spécifiques des pays tiers concernés.
3. Where a plant, plant product or other object originating in or being dispatched from a third country poses a pest risk of an unacceptable level due to the likelihood that it hosts a Union quarantine pest, and that pest risk cannot be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex II, the Commission shall amend the implementing act referred to in paragraph 2 accordingly to include in it that plant, plant product or other object and the third countries, groups of third countries or specific areas of third countries concerned.

3. 3. Par dérogation à l'article 40, paragraphe 1, à l'article 41, paragraphe 1, à l'article 42, paragraphe 2, à l'article 72, paragraphe 1, et à l'article 73, les végétaux, produits végétaux et autres objets peuvent être introduits sur le territoire de l'Union et transiter par ledit territoire à destination d'un pays tiers sous forme de transit ou de transbordement (ci-après dénommé «transit phytosanitaire»), dès lors qu'ils remplissent les deux conditions suivantes:

By way of derogation from Article 40(1), Article 41(1), Article 42(2), Article 72(1) and Article 73, plants, plant products and other objects may be introduced into, and be passed through, the Union territory to a third country, either in the form of transit or transhipment (‘phytosanitary transit’), if they fulfil both of the following conditions:

By way of derogation from Article 82, where a plant, plant product or other object, introduced into the Union territory from a third country, which for movement within the Union territory requires a plant passport pursuant to the implementing acts referred to in Article 74(1) and 75(1), such a passport shall be issued where the checks pursuant to Article 47(1) of Regulation (EU) No ./.. concerning the introduction of the respective plant, plant product or other object have been completed satisfactorily and have come to the result that the plants, plant products or other objects concerned fulfil the substantive requirements for issuance of a plant passport according to Article 80 and, where appropriate, Article 81 .

Lorsque deux lots ayant chacun fait l’objet d’un passeport phytosanitaire sont groupés en un seul lot, l’opérateur autorisé responsable de ce nouveau lot, ou l’autorité compétente agissant à la demande d’un opérateur professionnel, émet un passeport phytosanitaire pour ledit lot.
Where two lots, for each of which a plant passport has been issued, are combined into a single lot, the authorised operator responsible for that new lot, or the competent authority acting on request of a professional operator, shall issue a plant passport for that lot.

Le matériel d’emballage en bois des envois de marchandises spécifiées est soumis aux contrôles phytosanitaires prévus à l’article 13 bis, paragraphe 1, point b) iii), de la directive 2000/29/CE, aux fréquences minimales établies dans l’annexe I de la présente décision, afin de confirmer que ledit matériel répond aux exigences énoncées à l’annexe IV, partie A, chapitre I, points 2 et 8, de la directive 2000/29/CE.
The wood packaging material of consignments of the specified commodities shall be subject to the plant health checks provided for in Article 13a(1)(b)(iii) of Directive 2000/29/EC at the minimum frequencies set out in Annex I to this Decision to confirm that the wood packaging material meets the requirements laid down in points (2) and (8) of Section I of Part A of Annex IV to Directive 2000/29/EC.

(33) Quand, à l’égard de certains végétaux, produits végétaux ou autres objets quittant le territoire de l’Union vers un pays tiers, il n’existe pas d’accord phytosanitaire bilatéral entre l’Union et ledit pays et que le droit de ce dernier ne s’applique pas, il convient de le protéger des organismes de quarantaine de l’Union en raison de leur caractère nuisible reconnu, sauf quand la présence d’un organisme de quarantaine de l’Union est officiellement constatée dans ce pays tiers et ne fait pas l’objet d’un contrôle officiel, ou quand il peut être raisonnablement établi que cet organisme ne répond pas aux critères permettant de le qualifier d’organisme de quarantaine dans ce pays.
(33) Where, as regards certain plants, plant products or other objects moved out of the Union territory to third countries, no bilateral phytosanitary agreement concluded by the Union with a third country and no phytosanitary legislation of a third country applies, protection should be offered to third countries against Union quarantine pests because of their acknowledged harmful nature, except where a Union quarantine pest is officially known to be present in the third country concerned and not under official control, or where it can be reasonably assumed that that Union quarantine pest does not meet the criteria to qualify as a quarantine pest for the third country concerned.
