Starting with the 2007 budget, with a view to ensuring that the amounts for the financing of the common agricultural policy currently under subheading la (market measures and direct aids) respect the annual ceilings set out in the Decision of the Representatives of the Governments of the Member States, meeting within the Council on 18 November 2002, concerning the Conclusions of the European Council meeting in Brussels on 24 and 25 October 2002, an adjustment of the direct payments shall be fixed when the forecasts for the financing of the measures under subheading 1a for a given budget year, increased by the amounts given in Articles 143d and 143e and before application of modulation provided for in Article 10(2), indicate that the abovementioned annual ceiling, taking into account a margin of EUR 300 million below that ceiling, will be exceeded. This is without prejudice to the financial perspectives for 2007-2013".

Notes that heading 5 will be under considerable pressure in 2005 due, among other things, to the effects that the new gross national income estimates will have on the technical adjustment of the Financial Perspective and the resulting reduction of the ceiling; recalls that all the Secretaries General of the institutions presented an estimation of needs in 2005 in the third report on the evolution of heading 5; points out that the estimation provided is no longer compatible with the adjusted ceiling of the Financial Perspective in 2005; urges all institutions, therefore, to fine-tune and scale down their needs when they present their 2005 estimates of expenditure, so that the ceiling of heading 5 is not exceeded, as is also outlined in the attached declaration on heading 5;

Starting with the budget 2007, with a view to ensuring that the amounts for the financing of the common agricultural policy currently under subheading 1a (market measures and direct aids) respect the annual ceilings set out in the Decision of the Representatives of the Governments of the Member States, meeting within the Council on 18 November 2002, concerning the Conclusions of the European Council meeting in Brussels on 24 and 25 October 2002, an adjustment of the direct payments shall be fixed when the forecasts indicate that the amounts foreseen under subheading 1a taking into account a margin of EUR 300 million below the amounts foreseen and before application of modulation provided for in Article 10(2), will be exceeded in a given budget year. This is without prejudice to the financial perspectives for 2007-2013.

Recalls that the budgetary authority, in particular following Parliament's initiative, managed in the 2003 budget, by means of a frontloading operation, to make appropriations available under the ceiling of heading 5 of the financial perspective to allow the European institutions to prepare for enlargement, despite the fact that the financial perspective did not make provision to allow institutions to prepare to welcome new Member States before accession; considers that using available margins in each section of the budget to anticipate expenditure is a useful instrument to reduce the pressure in the following budget and to make the best use of resources;
