In the event that the person concerned was not compulsorily subject to the legislation of a Member State before that period, the latter shall be taken into account by the institution of the Member State to whose legislation the person concerned was compulsorily subject for the first time after that period.

2. 2. The prior consultation shall be carried out by the EDPS following receipt of a notification from the Data Protection Officer that shall contain at least a general description of the envisaged processing operations, an assessment of the risks to the rights and freedoms of data subjects, the measures envisaged to address those risks, safeguards and security measures and mechanisms to ensure the protection of personal data and to demonstrate compliance with this Regulation, taking into account the rights and legitimate interests of the data subjects and other persons concerned.

In order to ascertain whether a purpose of further processing is compatible with the purpose for which the personal data are initially collected, the controller, after having met all the requirements for the lawfulness of the original processing, should take into account, inter alia: any link between those purposes and the purposes of the intended further processing; the context in which the personal data have been collected, in particular the reasonable expectations of data subjects based on their relationship with the controller as to their further use; the nature of the personal data; the consequences of the intended further processing for data subjects; and the existence of appropriate safeguards in both the original and intended further processing operations.

Enfin, interrogée sur la question de savoir si la directive permet à la personne concernée de demander que des liens vers des pages web soient supprimés d’une telle liste de résultats au motif qu’elle souhaiterait que les informations y figurant relatives à sa personne soient « oubliées » après un certain temps, la Cour relève que, s’il est constaté, suite à une demande de la personne concernée, que l’inclusion de ces liens dans la liste est, au stade actuel, incompatible avec la directive, les informations et liens figurant dans cette liste doivent être effacés.
Finally, in response to the question whether the directive enables the data subject to request that links to web pages be removed from such a list of results on the grounds that he wishes the information appearing on those pages relating to him personally to be ‘forgotten’ after a certain time, the Court holds that, if it is found, following a request by the data subject, that the inclusion of those links in the list is, at this point in time, incompatible with the directive, the links and information in the list of results must be erased.

En outre, après avoir évalué l’ensemble de la situation, et en fonction de la gravité du délit (falsification de document, mariage de complaisance avec l’aide de la criminalité organisée par exemple), elles peuvent aussi conclure que la personne concernée représente une menace réelle, constante et suffisamment grave pour l’ordre public et, sur cette base, émettre, en plus de l’ordre d’expulsion, une interdiction du territoire prohibant toute nouvelle entrée sur le territoire pendant une certaine période.
In addition, after assessing all relevant circumstances and depending on the gravity of the offence (for instance, forgery of a document, marriage of convenience with involvement of organised crime), national authorities may also conclude that the person represents a genuine, continuous and sufficiently serious threat to public order and, on this basis, also issue an exclusion order in addition to expelling him/her - thus prohibiting his/her re-entry into the territory for a certain period of time.

2. Lorsque la personne concernée doit être renvoyée vers un État membre à la suite d’un transfert exécuté par erreur ou de l’annulation, sur recours ou demande de révision, de la décision de transfert après l’exécution du transfert, l’État membre ayant initialement procédé au transfert supporte les coûts liés au renvoi de la personne concernée sur son territoire.
2. Where the person concerned has to be transferred back to a Member State as a result of an erroneous transfer or of a transfer decision that has been overturned on appeal or review after the transfer has been carried out, the Member State which initially carried out the transfer shall be responsible for the costs of transferring the person concerned back to its territory.

Consequently, our association recommends that the disclosure of personal information from the private sector be managed with the same flexibility accorded in the case of public sector documents under subsection 8(3) of the Privacy Act, with the exception of the protection period specified in the Regulations, which should be extended to 100 years after the creation of the document—on this, we agree with the Institut d'histoire—or to 20 years after the death of the individual.
