La présente décision ne doit pas s’appliquer au transfert de données à caractère personnel effectué par des responsables du traitement établis dans l’Union européenne vers des responsables du traitement établis en dehors de l’Union européenne qui relèvent du champ d’application de la décision 2001/497/CE de la Commission du 15 juin 2001 relative aux clauses contractuelles types pour le transfert de données à caractère personnel vers des pays tiers en vertu de la directive 95/46/CE (5).
This Decision should not apply to the transfer of personal data by controllers established in the European Union to controllers established outside the European Union which fall within the scope of Commission Decision 2001/497/EC of 15 June 2001 on standard contractual clauses for the transfer of personal data to third countries, under Directive 95/46/EC (5).

Accordingly, this Framework Decision does not affect the protection of personal data under Community law, in particular as provided for in Directive 95/46/EC, in Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (4) and in Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) (5).
