Having regard to Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freezing of funds and other financial resources in respect of the Taliban of Afghanistan , and in particular Article 7(1), first indent, thereof,

J’invite tous les États membres et la Commission à se battre contre le renvoi de ces personnes en Afghanistan.
I would urge all the Member States and the Commission to fight against sending these people back to Afghanistan.

Les principes auxquels s’est ainsi référé le Tribunal et qui ne sont pas contestés par la République française ressortent également de la jurisprudence de la Cour [voir, dans le cadre du règlement (CE) n° 881/2002 du Conseil, du 27 mai 2002, instituant certaines mesures restrictives spécifiques à l’encontre de certaines personnes et entités liées à Oussama ben Laden, au réseau Al-Qaida et aux Taliban, et abrogeant le règlement (CE) n° 467/2001 du Conseil interdisant l’exportation de certaines marchandises et de certains services vers l’Afghanistan, renforçant l’interdiction des vols et étendant le gel des fonds et autres ressources financières décidées à l’encontre des Taliban d’Afghanistan (JO L 139, p. 9), arrêt Kadi et Al Barakaat International Foundation/Conseil et Commission, précité, points 338 à 341].

Commissioner, as you know, we are also concerned about the tragic situation which, according to the Under-Secretary General responsible for humanitarian affairs at the UN, is threatening one million people in Afghanistan with famine.

13. prie les autorités afghanes de s'employer, avec le soutien de la communauté internationale, à empêcher la fuite hors de l'Afghanistan des personnes cherchant à échapper à la justice, de même qu'à contribuer au retour ordonné et à la réinsertion dans la société des réfugiés et des personnes déplacées;
13. Calls upon the Afghan authorities, assisted by the international community, to make every effort to prevent the flight from Afghanistan of those seeking to avoid justice, and to assist the orderly return and reintegration into society of refugees and displaced persons;
