Bien que la Cour ait confirmé qu'en vertu des dispositions du règlement 1408/71 le remboursement ne pouvait se faire qu'aux tarifs de l'État membre dans lequel le traitement est dispensé, il a été retenu qu'au nom du principe de la libre prestation de services, la personne assurée pouvait prétendre à un remboursement complémentaire de la part de l'État membre d'assurance si la législation de celui-ci prévoit un niveau supérieur de remboursement pour un tel traitement hospitalier reçu dans l'État d'assurance.
Although the Court confirmed that under the rules of Regulation 1408/71 reimbursement could only be made according to the tariffs of the Member State where the treatment was provided, it held that, under the principle of freedom to provide services, the insured person was entitled to additional reimbursement from the Member State of insurance if the latter's legislation would have provided for a higher level of reimbursement had the hospital treatment been received there.
