À compter du 21 avril 2011, Samsung a intenté des actions en cessation à titre préliminaire et permanent contre Apple devant des juridictions françaises, allemandes, italiennes, néerlandaises et britanniques, sur la base de certains de ses brevets essentiels pour la norme UMTS.
From 21 April 2011 onwards, Samsung sought preliminary and permanent injunctions against Apple before courts in France, Germany, Italy, the Netherlands and the United Kingdom, on the basis of certain of its UMTS SEPs.

Le 21 décembre 2012, la Commission a adopté une communication des griefs dans laquelle elle estimait, à titre préliminaire, que l’introduction par Samsung, sans aucune justification objective, d’injonctions de cessation à titre préliminaire et permanent contre Apple Inc (ci-après «Apple») devant les juridictions de différents États membres et fondées sur ses brevets essentiels pour la norme liée à la technologie UMTS (système universel de télécommunications mobiles) suscitait des préoccupations au regard de l’article 102 TFUE et de l’article 54 de l’accord EEE.
On 21 December 2012, the Commission adopted a Statement of Objections (‘SO’), in which it reached the preliminary view that Samsung’s seeking of preliminary and permanent injunctions against Apple Inc (‘Apple’) before the courts of various Member States on the basis of its standard essential patents (‘SEPs’) covering the Universal Mobile Telecommunications Service (‘UMTS’) technology without any objective justification, raised concerns under Article 102 TFEU and Article 54 of the EEA Agreement.

Samsung offered commitments in order to address the competition concerns related to Samsung’s seeking of preliminary (interlocutory) and permanent injunctions against Apple Inc (‘Apple’) before the courts of various Member States on the basis of its UMTS (2) standard essential patents (‘SEPs’) which it has committed to license on fair, reasonable and non-discriminatory (‘FRAND’) terms during the standard-setting process in the European Telecommunications Standards Institute (‘ETSI’).

Compte tenu des circonstances exceptionnelles en l’espèce, la Commission a conclu, à titre préliminaire, que les actions intentées à titre préliminaire et permanent, sans aucune justification objective, par Samsung contre Apple sur la base de ses brevets essentiels pour la norme UMTS soulevaient des doutes quant à la compatibilité de ces actions avec l’article 102 du traité sur le fonctionnement de l’Union européenne (TFUE).
The Commission preliminarily concluded that Samsung’s seeking of preliminary and permanent injunctions against Apple on the basis of its UMTS SEPs, in view of the exceptional circumstances of the case and in the absence of any objective justification, raised concerns as to the compatibility of the seeking of such injunctions with Article 102 TFEU.
