3.2.7 Il a été demandé aux États membres s'ils estimaient qu'il y aurait lieu de faire passer certains projets de l'annexe II à l'annexe I. Certains États membres l'ont déjà fait en intégrant certains projets dans leur propre version de l'annexe I ou en mettant en place des seuils d'obligation pour certains projets relevant de l'annexe II. Toutefois le groupe le plus nombreux (Autriche, Danemark, Grèce, Pays-Bas, Espagne, Suède, Royaume-Uni) était d'avis qu'il n'y avait pas lieu de faire passer des projets à l'annexe I. 3.2.7 The Member States were asked whether they believed that there was a case for moving some projects from Annex II to Annex I. Some Member States have already done this by placing some projects in their own version of Annex I or by having mandatory thresholds for certain Annex II projects. However, the largest single proportion of respondents felt that there is no case for moving projects from Annex II to Annex I (i.e. Austria, Denmark, Greece, Netherlands, Spain, Sweden, UK). There was some consensus on the view that it was far too early to judge whether the Annex I and II lists needed further revision and that there needs to be far more research on the relationship between the Annexes and how the system operates in practice across the EU as a whole.

En fait, le trafic illicite, si l’on considère qu’il est illicite d’acheter des cigarettes bon marché dans un pays de l’Union, où la taxe a été acquittée, et de les revendre dans un autre pays de l’Union, où elles sont plus chères, ne l’est pas à mes yeux, car c’est là le fonctionnement normal du marché unique. Toutefois, dans la mesure où le trafic est illicite, ou si la taxe n’a pas été acquittée, comme dans le cas de l’Angleterre, la situation ne changera pas pour ce pays, qui souffre réellement du trafic de cigarettes, puisque 50 % des cigarettes qui y sont fumées ont été introduites illicitement dans ce pays, où la taxation est aussi élevée que le prix même des cigarettes. L’Angleterre ne devrait donc pas voir sa situation changer, parce que les prix pratiqués en Belgique, aux Pays-Bas ou en France, pays d’où part la contrebande, ne seront pas affectés par la proposition de la Commission.
Indeed smuggling – if it is smuggling to buy cheap cigarettes in one country of the Union in which the tax on them has been paid and sell them in another country in the Union in which they are more expensive, which in my view it is not, it is the normal working of the single market, but insofar as it is smuggling or if the tax is not paid, as in the case of England, where the situation will not change and which has a serious cigarette smuggling problem, with 50% of cigarettes smoked in England smuggled in, precisely because the tax costs as much as the price of the cigarettes, the situation will not be affected in England because the Commission proposal will not affect prices in Belgium, Holland or France, which is where the smuggled cigarettes come from.
