Lorsque des membres de l'organe d'administration ou de direction de la société partie à une opération visée à l'article 25, paragraphe 1, ou de l'organe d'administration ou de direction d'une entreprise mère au sens de l'article 1er de la septième directive 83/349/CEE du Conseil du 13 juin 1983 fondée sur l'article 50, paragaphe 2, point g), du traité, concernant les comptes consolidés ou cette entreprise mère elle-même, ou encore des particuliers agissant en leur propre nom mais pour le compte de ces membres ou de cette entreprise, sont parties à une telle opération, les États membres veillent, par des garanties adéquates, à ce que cette opération ne soit pas contraire aux intérêts de la société.
In cases where individual members of the administrative or management body of the company being party to a transaction referred to in Article 25(1), or of the administrative or management body of a parent undertaking within the meaning of Article 1 of Seventh Council Directive 83/349/EEC of 13 June 1983 based on the Article 50(2)(g) of the Treaty on consolidated accounts or such parent undertaking itself, or individuals acting in their own name but on behalf of the members of such bodies or on behalf of such undertaking, are counterparties to such a transaction, Member States shall ensure through adequate safeguards that such transaction does not conflict with the company's best interests.

Malgré les chiffres encourageants, selon lesquels environ 85 % de ce type de déchets sont collectés, il apparait cependant que si l’on compare la quantité de déchets collectés et la quantité de ce type d’équipements vendus sur le marché, 65 % de ces derniers sont collectés, tandis qu’une grande partie des déchets ne sont pas communiqués aux autorités ni traités correctement.
In spite of the positive figures, according to which approximately 85% of this type of waste is collected, it is nevertheless found that if we compare the quantity collected with the quantity of such equipment sold on the market, we see that 65% of the equipment sold is collected, while a large part of these data is not reported to the authorities or suitably processed.

(13) La présente décision est conçue pour s'inscrire dans un cadre cohérent qui inclut également la décision n° ./2007/CE du Parlement européen et du Conseil du .portant création du Fonds pour les frontières extérieures pour la période 2007-2013 dans le cadre du programme général "Solidarité et gestion des flux migratoires" , la décision n° ./2007/CE du Parlement européen et du Conseil du . portant création du Fonds européen pour le retour pour la période 2008-2013 dans le cadre du programme général "Solidarité et gestion des flux migratoires" et la décision ./2007/CE du Conseil du .portant création du Fonds européen pour l'intégration des ressortissants de pays tiers pour la période 2007-2013 dans le cadre du programme général "Solidarité et gestion des flux migratoires" , et qui a pour objectif de traiter la question du partage équitable des responsabilités entre États membres au regard de la charge financière découlant de l'introduction d'une gestion intégrée des frontières extérieures de l'Union européenne et de la mise en œuvre des politiques communes d'asile et d'immigration, élaborées conformément à la troisième partie, titre IV, du traité.
(13) This Decision is designed to form part of a coherent framework, which also includes Decision No ./2007/EC of the European Parliament and of the Council of .establishing the External Borders Fund for the period 2007-2013 as part of the General programme "Solidarity and Management of Migration Flows" , Decision No ./2007/EC of the European Parliament and of the Council of .establishing the European Return Fund for the period 2008-2013 as part of the General programme "Solidarity and Management of Migration Flows" *, and Council Decision./2007/EC of .establishing the European Fund for the Integration of Third-country Nationals for the period 2007-2013 as part of the General programme "Solidarity and Management of Migration Flows" *, which aims to address the issue of fairly sharing responsibilities between Member States as concerns the financial burden arising from the introduction of integrated management of the European Union's external borders and from the implementation of common policies on asylum and immigration, as developed in accordance with Title IV of Part Three of the Treaty.
