Notwithstanding the provisions of paragraph 1 of article 10, where a contract of carriage by sea provides explicitly that a specified part of the carriage covered by the said contract is to be performed by a named person other than the carrier, the contract may also provide that the carrier is not liable for loss, damage or delay in delivery caused by an occurrence which takes place while the goods are in the charge of the actual carrier during such part of the carriage.

(2) Pour l’application de la présente partie, toute personne qui, n’étant pas un transporteur aérien titulaire de licence, vend au Canada le titre de transport pour le transport aérien d’une personne, lorsque ce transport doit être entièrement ou partiellement exécuté par un transporteur aérien titulaire de licence, est, pour la perception du prix du transport, le mandataire du transporteur qui exécute la totalité ou toute partie de ce transport, selon le cas; elle perçoit les taxes imposées par la présente partie pour le compte de ce transporteur aérien et elle lui transmet ensuite les sommes perçues.
(2) A person who, not being a licensed air carrier, sells in Canada transportation of a person by air that is to be provided in whole or in part by a licensed air carrier is, in respect of the payment for that transportation and for the purposes of this Part, the agent of the first licensed air carrier who provides the transportation by air or any part thereof, as the case may be, and that person shall levy and collect on behalf of that licensed air carrier the taxes imposed by this Part and transmit them to the licensed air carrier.

If a person is not entitled to a benefit because he or she has not accumulated sufficient creditable periods under the legislation of a Party, the entitlement of that person to that benefit shall be determined by totalizing creditable periods under the legislation of both Parties, as specified in paragraphs 2 through 4, provided that the periods do not overlap.

(2) The Minister may grant a licence to any person applying therefor under subsection (1) and may, by regulation, exempt any person or class of persons from obtaining a licence under this section in respect of a specified Part, and any person who is a member of a class of small manufacturer or producer the members of which are exempted, pursuant to subsection 54(2), from payment of consumption or sales tax on goods manufactured or produced by them shall, whether or not he is a person or member of a class of persons exempted from obtaining a licence under this section, be exempt from payment of excise tax on goods manufactured or produced by him.

(2) Where a member of the Force is retired by reason of misconduct, the fact of such retirement and the circumstances thereof shall be reported to the Pension Board established pursuant to section 21 of the Royal Canadian Mounted Police Superannuation Act, and if the Board, after investigation of the circumstances surrounding any retirement reported to it under this subsection, reports to the Minister that it is in the public interest by reason of good and faithful service rendered by the member of the Force before the time of the misconduct to grant a pension, the Minister may recommend accordingly to the Treasury Board and the Governor in Council may, on the report of the Treasury Board in such case, grant a pension equal to the whole or any part specified by the Treasury Board of any pension that might have been granted to him if he had been retired in consequence of permanent infirmity of body or mind.
