La partie requérante invoque des indices permettant de conclure à l’existence d’un lien d’affectation contraignant entre, d’une part, la taxe sur les messages publicitaires et la taxe sur les communications électroniques et, d’autre part, les subventions budgétaires versées à France Télévisions, tant d’un point de vue juridique, en tenant compte de l’ensemble des textes nationaux pertinents, que d’un point de vue économique, en tenant compte du mécanisme de détermination du montant de l’aide, du taux de la taxe et de son utilisation effective.
The applicant cites evidence of a binding link between, on the one hand, the tax on advertising messsages and the tax on electronic communications and, on the other hand, the budgetary grants paid to France Télévisions, both from a legal point of view, taking account of all the relevant national legislation, and from an economic point of view, taking account of the mechanism for determining the amount of the aid, of the rate of the tax and of its actual use.
