11. Après avis et réquisition au gardien de port par toute partie intéressée, le gardien de port ou l’un de ses adjoints devra se rendre personnellement à tout entrepôt, maison ou quai, et y examiner les marchandises, colis, matériaux, produits ou autres effets que l’on prétendra avoir été avariés à bord d’un navire, en notifiant d’abord le patron, l’agent ou autre représentant du navire de sa visite, et s’informera, examinera et constatera la nature, la cause et l’étendue de l’avarie, en prendra note et inscrira dans les registres de son bureau un rapport détaillé et complet à ce sujet; et le gardien de port aura le droit d’appeler un ou deux experts, à sa discrétion, qui l’aideront dans cette inspection, et qui feront et signeront un rapport à ce sujet, lequel sera conservé dans le bureau du gardien de port, et qui, pour ce service, auront droit à des honoraires; et les frais d’inspection seront payés par celui ou ceux qui demanderont l’inspection et constitueront une créance légale contre toute personne responsable de l’avarie à la partie qui aura demandé l’inspection; pourvu toujours que cette partie notifie la personne ainsi responsable, son agent ou représentant (si elle est domiciliée ou a une place d’affaires à Montréal), de son intention de faire cette inspection, et de la date et de l’endroit où elle aura lieu.
11. Upon notice and request to the Port Warden by any party interested, the Port Warden or one of his Deputies shall proceed in person to any warehouse, dwelling or wharf, and examine any merchandise, package, material, produce or other property said to have been damaged on board of any vessel, first notifying the master, agent or other representative of such vessel thereof, and shall enquire and examine into and ascertain the nature, cause and extent of such damage, make a memorandum thereof, and record in the books of his office a full and complete statement thereof; and the Port Warden shall be entitled to call in one or two experts in his discretion, who shall assist him in such survey, and who shall make and sign a report on the same to be kept in the office of the Port Warden, and who shall, for such service, be entitled to a fee; and the cost of the survey shall be paid by the party or parties calling for the survey and shall be a lawful charge against any person liable for such damage to the party calling for such survey: Provided always, that such party shall notify the person so liable, his agent or representative (if he be resident or have a place of business in Montreal) of the intention to hold such survey, and of the time and place thereof.

Le présent Accord ne s’applique pas aux lois ou aux règlements qui étendent les régimes actuels d’une Partie à une nouvelle catégorie de bénéficiaires si l’autorité compétente de ladite Partie notifie l’autorité compétente de l’autre Partie dans un délai de trois mois à compter de la date de la publication ou de la proclamation officielle de ladite loi ou desdits règlements qu’aucune extension de l’Accord n’est prévue.
3. This Agreement shall not apply to laws or regulations which extend the existing legislation of a Party to a new category of beneficiaries if the competent authority of that Party notifies the competent authority of the other Party within three months from the date of the official publication or proclamation of such laws or regulations that no such extension of the Agreement is intended.

If within three months after its notification to the States Parties a majority of the States Parties register their disapproval, the revision shall not become effective and the Depositary shall refer the matter to a meeting of the States Parties.

3. Unless either Party notifies the other that this Agreement terminates at the end of the initial period, this Agreement shall continue in force after the initial period until such time as either Party gives notice in writing to the other Party of its intention to terminate this Agreement.
