4. Contrary to what has been noted by the Commission in its interpretative Communication of 2003, the Court considered that flag State rules apply not only where goods actually are carried during the international leg of the voyage which follows or precedes the cabotage leg of the voyage but also when this voyage is made in ballast (without cargo on board).
