changing the voting rules at the last stage of the comitology procedure (the Appeal Committee), so that only votes in favour or against an act are taken into account; this will reduce the use of abstentions and the number of situations where the Committee is unable to take a position and the Commission is obliged to act without a clear mandate from the Member States; involving national Ministers by allowing the Commission to make a second referral to the Appeal Committee at Ministerial level if national experts do not take a position; this will ensure that sensitive decisions are discussed at the appropriate political level; increasing voting transparency at the Appeal Committee level by making public the votes of Member State representatives; ensuring political input by enabling the Commission to refer the matter to the Council of Ministers for an Opinion if the Appeal Committee is unable to take a position.

To the extent that it applies to third-country nationals who do not fulfil or who no longer fulfil the conditions of entry in accordance with the Schengen Borders Code, this Directive constitutes a development of provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis ; moreover, in accordance with Articles 1 and 2 of the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, and without prejudice to Article 4 of the said Protocol, the United Kingdom is not taking part in the adoption of this Directive and is therefore not bound by it in its entirety or subject to its application.

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.

15. invite les employeurs à participer davantage à la promotion, au soutien et au renforcement du processus de non-discrimination sur le lieu de travail; souligne l'intérêt de la participation positive des employeurs et les effets positifs que peut avoir une politique de diversité sur le lieu de travail; applaudit à la conclusion des négociations des partenaires sociaux européens concernant un accord-cadre en matière de harcèlement et de violence sur le lieu de travail mettant en œuvre la législation existante en la matière comme exemple de la promotion de la dignité de l'emploi en Europe; invite la Commission à vérifier que ces accords sont réellement respectés et appliqués; exhorte les employeurs, dans le cadre de la responsabilité sociale des entreprises, à s'employer à garantir l'égalité et à lutter contre les discriminations reposant sur la race ou l'origine ethnique et contre l'exclusion liée à l'éducation et à la formation des travailleurs;
15. Calls on employers to participate more broadly in promoting, supporting and strengthening the process of non-discrimination in the workplace; stresses the importance of the positive involvement of employers and the positive effects of diversity policy on the workplace; welcomes the conclusion of the negotiations of the European social partners on a framework agreement on harassment and violence in the workplace and enforcing existing legislation in this sphere as an example of how to promote decent work in Europe; calls on the Commission to check that such agreement is actually complied with and implemented; urges employers, in accordance with the principle of corporate social responsibility, to uphold equality and combat racial and ethnic discrimination and exclusion with regard to education and training for workers;
