(2) Lorsque le demandeur serait le propriétaire du permis, s’il lui était accordé, la présente règle s’applique à ce demandeur, mais lorsque le demandeur ne serait pas le propriétaire dudit permis, si accordé, elle s’applique à la personne ou à l’entreprise qui serait le propriétaire dudit permis si cette personne ou cette entreprise était le demandeur et lorsque, de la même façon, un taux de participation canadienne est déterminé pour un propriétaire, ce taux de participation canadienne est considéré comme étant le taux de participation canadienne du demandeur aux fins de l’article 121.
(2) Where the applicant would be the beneficial owner of the permit, if granted, this Rule shall apply to that applicant, but where the applicant would not be the beneficial owner of the permit, if granted, this Rule shall be applied to the person or enterprise that would be the beneficial owner of the permit as if that person or enterprise were the applicant and where in this manner a Canadian participation rate is determined for a beneficial owner, that Canadian participation rate shall be deemed to be the Canadian participation rate of the applicant for the purposes of section 121.

(b) the applicant’s Canadian ownership rate determined with regard to subsection (1) would not, in the application of sections 7 to 9 of the Petroleum Incentives Program Act for any relevant year, fall within the same appropriate range of Canadian ownership rate, as prescribed for that year by section 10 of that Act, as the applicant’s Canadian ownership rate calculated without regard to subsection (1).

(3) For the purposes of determining whether a Canadian ownership rate of the holder has decreased as stated in paragraph 43(1)(b) of the Act, the Canadian ownership rate of the holder of a certificate upon the occurrence of a prescribed circumstance is the Canadian ownership rate that would be determined for the purposes of an application by the holder based on information and documentation that are current as of the day or days determined as follows:
