(4) Par dérogation à la présente loi, le ministre doit déterminer à nouveau le taux de participation canadienne ou l’état de contrôle canadien conformément à la présente loi et aux règlements et délivrer un nouveau certificat en conséquence, s’il est d’avis que le taux de participation canadienne ou l’état de contrôle canadien indiqués au certificat n’ont pas été déterminés en conformité avec la présente loi et les règlements et que cela a causé un préjudice au titulaire du certificat.
(4) Notwithstanding anything in this Act, where the Minister is of the opinion that the Canadian ownership rate or control status stated in a certificate was not determined in accordance with this Act and the regulations to the prejudice of the person to whom the certificate was issued, the Minister shall redetermine the Canadian ownership rate or control status in accordance with this Act and the regulations and issue a new certificate accordingly.
