(2.02) If an amount or a portion of an amount would, in the absence of this subsection, be included in computing the exempt earnings, or deducted in computing the exempt loss, of a foreign affiliate of a corporation in respect of the corporation for a taxation year of the affiliate and the amount or portion arises from a disposition of property (other than money), at any time, to a person or partnership that was, at that time, a designated person or partnership in respect of the corporation where that disposition is a transaction (within the meaning of subsection 245(1) of the Act) that is, or would be (if the amount or portion were a tax benefit for the purposes of section 245 of the Act), an avoidance transaction (within the meaning of subsection 245(3) of the Act), the following rules apply:

(17) Si une somme est distribuée à un moment donné, dans le cadre d’un régime de pension agréé collectif, sur le compte d’un participant décédé au représentant légal du participant et qu’un survivant admissible du participant a droit à tout ou partie de la somme en règlement total ou partiel de ses droits à titre de bénéficiaire, au sens du paragraphe 108(1), de la succession du défunt, la somme ou la partie de somme, selon le cas, est réputée, pour l’application du paragraphe (16), avoir été distribuée à ce moment sur le compte du participant au survivant admissible et non au représentant légal, dans la mesure où le représentant légal et le survivant l’ont conjointement désignée à cet égard sur le formulaire prescrit présenté au ministre.
(17) If an amount is distributed at any time from a deceased member’s account under a PRPP to the member’s legal representative and a qualifying survivor of the member is entitled to all or a portion of the amount in full or partial satisfaction of the survivor’s rights as a beneficiary (as defined in subsection 108(1)) under the deceased’s estate, then, for the purposes of subsection (16), the amount or portion of the amount, as the case may be, is deemed to have been distributed at that time from the member’s account to the qualifying survivor (and not to the legal representative) to the extent that it is so designated jointly by the legal representative and the qualifying survivor in prescribed form filed with the Minister.

(7) Dans le cas où, au cours d’une année d’imposition donnée d’un contribuable bénéficiaire d’une fiducie testamentaire ou d’une fiducie non testamentaire qui est réputée exister par l’effet de l’article 143, une somme est déterminée à l’égard de la fiducie selon les alinéas a), a.1), a.4), a.5), b) ou e.1) de la définition de « crédit d’impôt à l’investissement » au paragraphe (9) pour son année d’imposition qui se termine dans l’année donnée, la fiducie peut, dans sa déclaration de revenu produite pour cette même année d’imposition, attribuer au contribuable la partie de cette somme qu’il est raisonnable de considérer, compte tenu des circonstances, y compris les modalités de la fiducie, comme se rapportant à lui et que la fiducie n’a attribuée à aucun autre de ses bénéficiaires. Cette partie de somme est à ajouter dans le calcul du crédit d’impôt à l’investissement du contribuable à la fin de l’année donnée et est à déduire dans le calcul du crédit d’impôt à l’investissement de la fiducie à la fin de son année d’imposition qui se termine dans l’année donnée.
(7) If, in a particular taxation year of a taxpayer who is a beneficiary under a testamentary trust or under an inter vivos trust that is deemed to be in existence by section 143, an amount is determined in respect of the trust under paragraph (a), (a.1), (a.4), (a.5), (b) or (e.1) of the definition “investment tax credit” in subsection (9) for its taxation year that ends in that particular taxation year, the trust may, in its return of income for its taxation year that ends in that particular taxation year, designate the portion of that amount that can, having regard to all the circumstances including the terms and conditions of the trust, reasonably be considered to be attributable to the taxpayer and was not designated by the trust in respect of any other beneficiary of the trust, and that portion shall be added in computing the investment tax credit of the taxpayer at the end of that particular taxation year and shall be deducted in computing the investment tax credit of the trust at the end of its taxation year that ends in that particular taxation year.
