The measures taken to avoid, prevent, reduce and, if possible, offset significant adverse effects on the environment, in particular on species and habitats protected under Council Directive 92/43/EEC and Directive 2009/147/EC of the European Parliament and of the Council , should contribute to avoiding any deterioration in the quality of the environment and any net loss of biodiversity, in accordance with the Union's commitments in the context of the Convention and the objectives and actions of the Union Biodiversity Strategy up to 2020 laid down in the Commission Communication of 3 May 2011 entitled ‘Our life insurance, our natural capital: an EU biodiversity strategy to 2020’.

When providing new solutions, it is important to capitalise on existing solutions implemented in the context of other European initiatives, avoid duplication of work, and ensure coordination and alignment of approaches and solutions across initiatives and policies, such as for instance the ISA programme established by Decision No 922/2009/EC of the European Parliament and of the Council (5), the Fiscalis programme established by Regulation (EU) No 1286/2013 of the European Parliament and of the Council (6), and Horizon 2020 established by Regulation (EU) No 1291/2013 of the European Parliament and of the Council (7).

Member States and other project promoters should carry out environmental assessments of plans and projects as provided for in Council Directive 92/43/EEC (8), Directive 2000/60/EC of the European Parliament and of the Council (9), Directive 2001/42/EC of the European Parliament and of the Council (10), Directive 2009/147/EC of the European Parliament and of the Council (11) and Directive 2011/92/EU in order to avoid or, where avoidance is not possible, to mitigate or compensate for negative impacts on the environment, such as landscape fragmentation, soil sealing and air and water pollution as well as noise, and to protect biodiversity effectively.

An integrated approach should be ensured by bringing together activities covered by the Seventh Framework Programme for research, technological development and demonstration activities (2007-2013) adopted by Decision No 1982/2006/EC, the Competitiveness and Innovation Framework Programme established by Decision No 1639/2006/EC of the European Parliament and of the Council (9) and the European Institute of Innovation and Technology (the EIT) established by Regulation (EC) No 294/2008 of the European Parliament and of the Council (10) to make participation easier, create a more coherent set of instruments and increase the scientific and economic impact, while avoiding duplication and fragmentation.

The ERIC Regulation was also to facilitate the quicker establishment of European research infrastructures by saving time in avoiding the repetition of negotiations, project by project, to analyse and discuss the best legal form for such international research organisations, with related advantages and disadvantages and the time saved in avoiding discussions in each national parliament related to the approval of a needed international agreement in case the framework provided for under the ERIC Regulation would not have existed.

13. Cohérence . Les mesures en relation avec le droit pénal adoptées de façon sectorielle sur une base communautaire doivent respecter la cohérence d’ensemble du dispositif pénal de l’Union, qu’il soit adopté sur la base du premier ou du troisième pilier, afin d’ éviter des dispositions pénales éparses et disparates. Dans la mesure où des règles spécifiques pour un domaine paraissent nécessaires pour mettre en œuvre les objectifs du traité CE, il y a lieu de clarifier, le cas échéant, la relation entre ces règles spécifiques et des règles horizontales. Il convient également d’éviter que les Etats membres ou les personnes concernées ne soient soumises à des obligations contradictoires. En utilisant son droit d’initiative, la Commission veillera scrupuleusement à préserver cette cohérence. Le Parlement et le Conseil devraient également tenir compte de cette nécessité dans leur organisation interne.
13. Consistency. The criminal-law measures adopted at sectoral level on a Community basis must respect the overall consistency of the Union’s system of criminal law, whether adopted on the basis of the first or the third pillar, to ensure that criminal provisions do not become fragmented and ill-matched. If a sector seems to require specific rules in order to implement the objectives of the EC Treaty, the relationship between these specific rules and the horizontal rules should if necessary be clarified. Care must also be taken to ensure that the Member States or the persons concerned are not required to comply with conflicting obligations. When using its right of initiative, the Commission will take the utmost care to ensure that this consistency is preserved. Parliament and the Council must also take account of this requirement in their own internal organisation.
