Toutefois, le Parlement invite également la Commission à effectuer en premier lieu une analyse d’impact approfondie avant d’agir plus avant sur le terrain réglementaire[30]. D’après le Parlement européen, la Commission devrait montrer, dans cette analyse d’impact, «qu’il est nécessaire, conformément au principe de subsidiarité, de mener une action au niveau de l’Union dans le but d’améliorer le droit européen en vigueur de façon à permettre aux victimes d’infractions à la législation de l’Union d’être indemnisées des dommages qu’elles ont subis et de contribuer ainsi à nourrir la confiance des consommateurs et à améliorer le fonctionnement du marché intérieur».
However, the Parliament also calls on the Commission to first of all carry out a thorough impact assessment before any further regulatory action is undertaken.[30] According to the European Parliament, the Commission should demonstrate in this impact assessment "that, pursuant to the principle of subsidiarity, action is needed at EU level in order to improve the current EU regulatory framework so as to allow victims of infringements of EU law to be compensated for the damage they sustain and thus to contribute to consumer confidence and smoother functioning of the internal market".

The Commission supports the good practice of some Committees which make the Commission's impact assessment the starting point for further analytical work by the European Parliament. This should ensure comparability with the Commission’s own impact assessment approach and avoid any duplication of effort.

On the request of the European Parliament the Commission launched a call for seeking professional support to establish the European Rare-Earth Competency Network (ERECON), a network that should bring together experts from Europe's universities, research institutes, policy-makers, think tanks, industry and experts from outside the EU in order to advance exchange of best-practice on REE, increase the understanding of the special properties of REE, make recommendations on research and promote the sustainable mining, recyclability and substitution of REE.

The Agency should monitor, in cooperation with the Commission, the Member States and relevant national authorities, the internal markets in electricity and natural gas and inform the European Parliament, the Commission and national authorities of its findings where appropriate.

The Commission also adopted a proposal for a Directive 'on the activities of institutions for occupational retirement provisions' [11] This initiative, once adopted by the Council and the European Parliament, should encourage labour mobility as it would make it possible to remain a member of the same pension fund, as is currently already the case for posted workers.
