1. Financial counterparties as defined in Article 2(8) of Regulation (EU) No 648/2012 and non-financial counterparties that meet the conditions referred to in Article 10(1)(b) thereof shall conclude transactions which are neither intragroup transactions as defined in Article 3 of that Regulation nor transactions covered by the transitional provisions in Article 89 of that Regulation with other such financial counterparties or other such non-financial counterparties that meet the conditions referred to in Article 10(1)(b) of Regulation (EU) No 648/2012 in derivatives pertaining to a class of derivatives that has been declared subject to the trading obligation in accordance with the procedure set out in Article 32 and listed in the register referred to in Article 34 only on:

(14) If a Canadian affiliate of an entrant bank and the entrant bank meet the conditions set out in paragraphs (12)(a) and (b) and jointly elect in accordance with subsection (11) to have this subsection apply, and the Canadian affiliate has not made an election under this subsection with any other entrant bank, the entrant bank is deemed to be the same corporation as, and a continuation of, the Canadian affiliate for the purposes of paragraphs 142.4(4)(c) and (d) in respect of any specified debt obligation disposed of by the Canadian affiliate.

Until the entry into force of Articles 37 and 88(3) of Regulation (EC) No 1698/2005, the Commission will declare State aid compatible with Article 87(3)(c) of the Treaty if it fulfils all the conditions of Articles 14(1), the first two indents of Article 14(2) and Article 15 of Regulation (EC) No 1257/1999, and any implementing rules of this Regulation adopted by the Commission, and if the beneficiaries fulfil cross-compliance obligations.

The Commission has therefore decided to close the procedure under Article 93(2) of the EC Treaty and that the aids to be granted to the company Bergrohr in Siegen, as described above, are common market compatible since they fulfil the conditions set under the derogation provided for in Article 93(2)(c) of the EC Treaty.
