20. rappelle que le Pakistan est tenu à des obligations en tant qu'État signataire du pacte international relatif aux droits civils et politiques et demande aux autorités compétentes du Pakistan de revoir le champ des réserves générales formulées relativement au pacte, dont certaines restreignent les droits inscrits dans la Constitution pakistanaise ou sont contraires à la notion de suprématie du droit international sur le droit national; estime que la façon dont les lois sur le blasphème sont appliquées aujourd'hui viole manifestement ces obligations et demande au SEAE de considérer cet aspect lors de l'examen d'une éventuelle application du régime SPG + au Pakistan à compter de 2013, ainsi que de rendre compte au Parlement européen à ce sujet;
20. Recalls that Pakistan has certain obligations as a signatory state of the International Covenant on Civil and Political Rights and calls on Pakistan's relevant authorities to engage in a process of reviewing the scope of the blanket reservations made to the ICCPR, some of which limit rights enshrined in the Constitution of Pakistan or are contrary to the notion of supremacy of international law over national law; believes that the way the blasphemy laws are currently implemented is in clear breach of these obligations and asks the EEAS to take this into account during the examination of a possible application of the GSP+ scheme to Pakistan from 2013 onwards, and report back to the EP on the matter;

– (EN) Monsieur le Président, je voudrais changer le paragraphe 14 comme suit: «invite une nouvelle fois le gouvernement du Pakistan à revoir en profondeur les lois sur le blasphème et leur application actuelle, y compris la peine de mort obligatoire ou la prison à vie prescrits par la section 295-C du code pénal pakistanais pour toute personne reconnue coupable de blasphème contre le prophète Mohammed, en vue d’apporter les amendements proposés par le ministère fédéral chargé des questions des minorités».
– Mr President, I would like to change paragraph 14 to the following: ‘Reiterates its call to the government of Pakistan to carry out a thoroughgoing review of the blasphemy laws and their current application, including the mandatory death penalty or life imprisonment prescribed by Section 295 C of the Pakistan Penal Code for anyone found guilty of blasphemy against the prophet Mohammed, with a view to implementing amendments as suggested by the Federal Minister for Minority Affairs’.

I have with me a strong statement – of this morning – by Mohtarma Benazir Bhutto, Chairperson of the Pakistan People’s Party, in which she welcomes this report for drawing attention to the right of self-determination of the Kashmiri people; for reaffirming the EU’s commitment to the settlement of dispute by peaceful means; for taking note of the impact of the earthquake and urging the European Union to help and support the Kashmiris; for supporting the role of the composite peace process in moving towards a durable settlement for the Kashmiris based on democracy, the rule of law and fundamental rights; for urging the Indian and Pakistan Governments to facilitate the ceasefire on the Line of Control by calling further on militant armed groups to enrol in a disarmament, demobilisation and rehabilitation process; for encouraging the Pakistan Government to transform the ceasefire in place in Siachin since 2003 into a lasting peace agreement; for urging both governments to allow international human rights organisations immediate and unrestricted access to all parts of the former princely state in order to investigate the human rights situation there; for calling on the Indian Government to put an end to all practices of extrajudicial killings, ‘disappearances’, torture and arbitrary detentions in Jammu and Kashmir; for calling on the Indian and Pakistani authorities to ease restrictions on travel between Srinagar and Muzaffarabad; for urging Pakistan to revisit its concepts of fundamental rights of freedom of expression, freedom of association, freedom of religious practices in Azad Jammu and Kashmir and Gilgit and Baltistan; for calling for the first-ever elections to be held in Gilgit and Baltistan and for seeking higher democratic representation in the Northern Areas.
