(5.1) La Bande de Oujé-Bougoumou est tenue d’octroyer immédiatement, sous le régime de la partie VIII, à la personne qui, avec le consentement explicite de la Oujé-Bougoumou Eenuch Association et jusqu’à l’entrée en vigueur du présent paragraphe, possédait ou occupait des terres constituées en terres de catégorie IA attribuées à la Bande de Oujé-Bougoumou aux termes de la convention complémentaire de la Bande de Oujé-Bougoumou ou un bâtiment de la Oujé-Bougoumou Eenuch Association situé sur ces terres, sans que cette personne soit titulaire d’un droit ou d’un intérêt visés aux paragraphes (1.1) ou (3.1), sur ces terres ou ce bâtiment, un droit ou un intérêt qui soit équitable en l’occurrence, compte tenu de la possession ou de l’occupation elle-même et des circonstances, à condition que l’intéressé en fasse la demande dans les deux ans suivant l’entrée en vigueur du présent paragraphe.
(5.1) If, immediately before the coming into force of this subsection, a person was in possession of, or occupied, with the explicit consent of the Oujé-Bougoumou Eenuch Association, land that became Category IA land of the Oujé-Bougoumou Band by virtue of the Oujé-Bougoumou Band Complementary Agreement, or a building owned by the Oujé-Bougoumou Eenuch Association and situated on that land, but that person was not a holder of a right or interest in that land or building referred to in subsection (1.1) or (3.1), the Oujé-Bougoumou Band shall, if that person so requests within two years after the coming into force of this subsection, without delay grant to that person under Part VIII a right or interest in that land or building that is equitable in the circumstances, taking into account that possession or occupation and all other relevant factors.

(3.1) La Bande de Oujé-Bougoumou est tenue d’octroyer immédiatement, sous le régime de la partie VIII, au titulaire d’un droit légalement octroyé par le ministre ou la Oujé-Bougoumou Eenuch Association, sur des terres constituées en terres de catégorie IA attribuées à la Bande de Oujé-Bougoumou aux termes de la convention complémentaire de la Bande de Oujé-Bougoumou ou sur un bâtiment situé sur ces terres, un droit équivalent à celui dont l’intéressé était titulaire jusqu’à l’entrée en vigueur du présent paragraphe, à condition que celui-ci en fasse la demande dans les deux ans suivant cette entrée en vigueur.
(3.1) If, immediately before the coming into force of this subsection, a person held a right or interest, lawfully granted by the Minister or the Oujé-Bougoumou Eenuch Association in land that became Category IA land of the Oujé-Bougoumou Band by virtue of the Oujé-Bougoumou Band Complementary Agreement, or in a building situated on that land, the Oujé-Bougoumou Band shall, if that person so requests within two years after the coming into force of this subsection, without delay grant to that person under Part VIII a right or interest that is equivalent to the person’s former right or interest, at which time the person’s former right or interest expires.

12.1 Pursuant to subparagraph 9.0.3A of the James Bay and Northern Quebec Agreement, the collectivity known as the Crees of Oujé-Bougoumou is constituted as a corporation, and that corporation may be legally designated by its English name, Oujé-Bougoumou Band, its French name, Bande de Oujé-Bougoumou, or its Cree name, Oujé-Bougoumou Eenuch, subject to section 16.

Under the agreements between the Oujé-Bougamou and Quebec in 1989 and 1992, it was established that in order to make room for Oujé-Bougoumou, those who were considered to be Mistissini at the signing of the James Bay and Northern Quebec Agreement would henceforth be considered as belonging to the Oujé-Bougoumou, and that on that basis certain lands would be taken from the Mistissini, with their accord, in order to be annexed to Oujé-Bougoumou.

La Convention de Oujé Bougoumou de 1989 avec le Québec prévoit essentiellement un appui financier et technique partiel pour la construction d’un village pour le groupe sur un site convenu, et établit l’objectif d’une attribution éventuelle de superficies bien définies de terres des catégories I et II aux Cris de Oujé-Bougoumou, en attendant la conclusion d’un accord avec le Canada et des négociations concernant le transfert de terres avec les Cris de Mistissini(28). Selon des dispositions essentielles de l’Entente Oujé-Bougoumou/Canada de 1992, le Canada s’est engagé à fournir le gros du financement pour le village de Oujé Bougoumou et à reconnaître les Cris de Oujé-Bougoumou comme entité juridique distincte et la neuvième bande crie en vertu de la CBJNQ et de la LCNQ, donc admissibles aux terres de catégories I et II comme le prévoit la Convention de 1989.
The 1989 Oujé-Bougoumou Agreement with Quebec, reduced to its essence, provided for partial financial and technical support for the construction of a village for the group at an agreed-upon site, and set the objective of eventual allocation to the Oujé-Bougoumou Crees of specific amounts of Category I and Category II lands, pending settlement with Canada and negotiations regarding a land transfer with the Crees of Mistissini (28) Under key provisions of the 1992 Oujé-Bougoumou/Canada Agreement, Canada committed to provide the bulk of funding for the Oujé-Bougoumou village, and to recognize the Oujé-Bougoumou Crees as a distinct legal entity and the ninth Cree band under both the JBNQA and the CNQA, with entitlement to Category I and Category II lands as set out in the 1989 Agreement.
