Member States shall ensure that where a collective management organisation does not grant or offer to grant multi-territorial licences for online rights in musical works or does not allow another collective management organisation to represent those rights for such purpose by 10 April 2017, rightholders who have authorised that collective management organisation to represent their online rights in musical works can withdraw from that collective management organisation the online rights in musical works for the purposes of multi-territorial licensing in respect of all territories without having to withdraw the online rights in musical works for the purposes of mono-territorial licensing, so as to grant multi-territorial licences for their online rights in musical works themselves or through any other party they authorise or through any collective management organisation complying with the provisions of this Title.

Zappalà, que je félicite pour son rapport équilibré - ait trouvé un compromis entre une approche horizontale et une approche sectorielle et ait veillé à ce que les organismes professionnels puissent apporter leur expertise dans la transposition de la directive.
We therefore welcome the fact that the Committee on Legal Affairs and the Internal Market and its rapporteur Mr Zappalà, whom I congratulate on his balanced report, have found a compromise between a horizontal and a sectoral approach, ensuring that professional organisations were able to contribute their expertise in the transposition of the directive.

Cette triple nécessité - multilatéralisme à sauver, OMC à réformer et nouveaux acteurs à reconnaître - devrait donc vraisemblablement nous porter à réclamer le lancement d’un processus qui puisse ensuite conduire à la création de certains organismes intermédiaires entre le secrétariat et l’Assemblée, au sein desquels cette nouvelle représentation puisse enfin trouver un terrain commun entre des acteurs qui représentent des zones géographiques, politiques, culturelles, sociales et économiques semblables mais différentes, afin qu’ils puissent créer un forum de haut niveau pour résoudre les problèmes avant qu’ils n’atteignent cette Assemblée qui, à Cancun, est réellement apparue comme une véritable cacophonie de langages et de positions.
Thus, this threefold need to save multilateralism, reform the WTO and recognise new players should presumably prompt us to call for a process to be launched which can then lead to the creation of some intermediary bodies in between the Secretariat and the Assembly, in which this new representation can, at last, establish common ground between players who represent geographical, political, cultural, social and economic areas which are similar but different, so that they can create a high-level forum where issues can be resolved before they reach that assembly which really did seem in Cancún to be a veritable cacophony of languages and positions.
