As regards the argument invoked by the Commission in its decision to initiate the procedure that the possible passing on of the advantage granted to insurers should be able to benefit not only insured persons/employees, but also employers (who contribute to the payment of part of the premiums), France and the CTIP consider that the employer’s contribution to financing contractual supplementary social protection schemes constitutes remuneration for employees and an advantage for the latter.

(18) Alors que le présent règlement devrait prévoir l'agrément d'un autre organisme pour assurer certaines fonctions en matière d'accréditation, la Coopération européenne pour l’accréditation (European co-operation for Accreditation – EA), dont la mission principale est de promouvoir un système transparent et axé sur la qualité, permettant d’apprécier la compétence des organismes d’évaluation de la conformité sur tout le territoire européen, gère un système d’évaluation par les pairs qui couvre les organismes nationaux d’accréditation des États membres et d’autres pays européens.
(18) While this Regulation should provide for the recognition of another body in respect of certain functions in the area of accreditation, the European co-operation for Accreditation (EA), whose main mission is to further a transparent and quality led system to evaluate the competence of conformity assessment bodies throughout Europe, is managing a peer evaluation system among national accreditation bodies from the Member States and other European countries.

(25) Pour garantir que la personne lésée ne reste pas sans l'indemnisation à laquelle elle a droit, il est nécessaire d'établir un organisme d'indemnisation auquel elle peut s'adresser au cas où l'entreprise d'assurance n'a pas désigné de représentant, retarde manifestement le règlement ou ne peut être identifiée. L'intervention de l'organisme d'indemnisation devrait être limitée aux rares cas particuliers où l'entreprise d'assurance n'a pas rempli ses obligations malgré l'effet dissuasif de sanctions éventuelles.
(25) It is necessary to make provision for a compensation body to which the injured party may apply where the insurance undertaking has failed to appoint a representative or is manifestly dilatory in settling a claim or where the insurance undertaking cannot be identified to guarantee that the injured party will not remain without the compensation to which he is entitled; the intervention of the compensation body should be limited to rare individual cases where the insurance undertaking has failed to comply with its duties in spite of the dissuasive effect of the potential imposition of penalties.
