S'il est d'accord avec le fait que l'objectif d'harmonisation n'est pas qu'un organe communautaire prenne des décisions individuelles positives ou négatives en matière de protection, il estime qu'un réexamen doit être réalisé sur les restrictions, dans le contexte du Titre IV du TCE (art. 68) aux possibilités de renvois préjudiciels à la Cour européenne de Justice afin de renforcer l'harmonisation et le contrôle juridictionnel.
While agreeing that the aim of harmonisation was not to allow a Community body to take individual decisions granting or refusing protection, the churches felt that there was a need to reconsider the restrictions under Title IV of the EC Treaty (Article 68) on the possibilities for seeking preliminary rulings from the European Court of Justice in order to further harmonisation and judicial review.
