Les États membres informent l’AEMF et la Commission de toute difficulté d’ordre général que rencontrent les OPCVM pour commercialiser leurs parts dans un pays tiers.
Member States shall inform ESMA and the Commission of any general difficulties which UCITS encounter in marketing their units in any third country.

Afin d’améliorer la sécurité juridique, il convient de garantir à un OPCVM qui commercialise ses parts dans un cadre transfrontalier un accès aisé, sous la forme d’une publication électronique et dans une langue usuelle dans la sphère financière internationale, à des informations complètes sur les dispositions législatives, réglementaires et administratives applicables spécifiquement aux modalités de commercialisation de parts d’OPCVM dans l’État membre d’accueil de l’OPCVM.
For the purpose of enhancing legal certainty there is a need to ensure that a UCITS which markets its units on a cross-border basis has easy access, in the form of an electronic publication and in a language customary in the sphere of international finance, to complete information on the laws, regulations and administrative provisions applicable in the UCITS host Member State, which specifically relate to the arrangements made for marketing of units of UCITS.

2. Les États membres informent aussi la Commission de toute difficulté d'ordre général que rencontrent les OPCVM pour commercialiser leurs parts dans un pays tiers.

Les OPCVM qui commercialisent leurs parts dans d'autres États membres que celui où ils sont situés sont tenus de le communiquer aux autorités compétentes du ou des États membres concernés en leur fournissant le prospectus, le prospectus simplifié et d'autres informations les concernant.
UCITS which market their units in Member States other than those in which they are situated are obliged to notify accordingly the competent authorities of the Member State(s) concerned by providing the full and simplified prospectuses and other relevant information.

1. A UCITS which markets its units in another Member State must comply with the laws, regulations and administrative provisions in force in that State which do not fall within the field governed by this Directive.
