Member States may allow information relating to impending developments or matters in the course of negotiation to be omitted in exceptional cases where, in the duly justified opinion of the members of the administrative, management and supervisory bodies, acting within the competences assigned to them by national law and having collective responsibility for that opinion, the disclosure of such information would be seriously prejudicial to the commercial position of the group, provided that such omission does not prevent a fair and balanced understanding of the group's development, performance, position and impact of its activity.

S’il est répondu par l’affirmative à la question 16: si une juridiction constate, suite à leur contestation, que des décisions rendues par l’administration fiscale de l’État membre sont illégales quant à la procédure en raison de l’omission du recueil d’informations et d’une demande adressée aux autorités compétentes d’un autre État membre, quelle conséquence la juridiction qui procède au contrôle des décisions rendues par l’administration fiscale de l’État membre doit-elle appliquer, compte tenu également de la question 14?
If the answer to question 16 is in the affirmative and the decisions adopted by the tax authority of the Member State are challenged before a court and are found to be unlawful in procedural terms on that ground, in other words, on the basis of failure to obtain information and the absence of a request, what action should the court hearing the action against the administrative decisions adopted by the tax authority of the Member State take, having regard also to the considerations set out in question 14?
