– having regard to Decision No ICC-02/05-01/09 of the Pre-Trial Chamber of the ICC of 27 August 2010 informing the UNSC and the Assembly of the States Parties to the Rome Statute about Omar al-Bashir's presence in the territory of the Republic of Kenya,

B. considérant que le Président Omar Al‑Bachir fait l'objet d'un mandat d'arrêt international émis le 4 mars 2009 par la CPI pour crimes contre l'humanité (meurtre, extermination, déportation, torture et viol) et crimes de guerre (planification d'attaques contre des civils et pillages), ainsi que d'une ordonnance du 12 juillet 2010 l'inculpant pour "génocide par meurtre, génocide par atteinte grave à l'intégrité physique ou psychologique des victimes, et génocide par soumission intentionnelle de chacun de ces groupes à des conditions d'existence devant entraîner leur élimination physique",
B. whereas on 4 March 2009 the ICC issued an international warrant for the arrest of the President al-Bashir for crimes against humanity (murder, extermination, deportation, torture and rape) and war crimes (planning attacks on civilians and looting), and President al-Bashir is also the subject of an order of 12 July 2010 indicting him for 'genocide by killing, genocide by causing serious bodily or mental harm and genocide by deliberately inflicting on each target group conditions of life calculated to bring about the group’s physical destruction',

A. considérant que le gouvernement kenyan a invité et accueilli le Président soudanais Omar Al‑Bachir à participer le 27 août 2010 aux cérémonies de promulgation de la constitution, sachant que ce dernier avait été inculpé par la CPI,
