(1) La directive 2001/18/CE du Parlement européen et du Conseil du 12 mars 2001 relative à la dissémination volontaire d'organismes génétiquement modifiés dans l'environnement et le règlement (CE) n° 1829/2003 du Parlement européen et du Conseil du 22 septembre 2003 concernant les denrées alimentaires et les aliments pour animaux génétiquement modifiés établissent pour l'autorisation d'organismes génétiquement modifiés (OGM) un cadre juridique détaillé pleinement applicable aux OGM destinés à la culture dans l'ensemble de l'Union, tels que les semences et autres matériels de multiplication végétale (ci-après dénommés, «OGM destinés à la culture»).
(1) Directive 2001/18/EC of the European Parliament and of the Council of 12 March 2001 on the deliberate release into the environment of genetically modified organisms and Regulation (EC) No 1829/2003 of the European Parliament and of the Council of 22 September 2003 on genetically modified food and feed establish a comprehensive legal framework for the authorisation of genetically modified organisms (GMOs), which is fully applicable to GMOs to be used for cultivation purposes throughout the Union as seeds or other plant-propagating material (hereinafter ‘GMOs for cultivation’).

Cet amendement n'est pourtant pas dénué d'importance: en effet, il précise et renforce les dispositions applicables concernant la dissémination volontaire dans l'environnement et la mise sur le marché d'organismes génétiquement modifiés (ci-après dénommés OGM), organismes d'une grande actualité et dont le traitement juridique est malaisé.
However, this amendment is not without significance since it seeks to specify and strengthen the provisions on the deliberate release into the environment and placing on the market of genetically modified organisms (hereafter GMOs), materials which are a highly topical issue and are difficult to pin down in legal terms.

La directive 2001/18/CE relative à la dissémination volontaire d’organismes génétiquement modifiés (OGM) dans l’environnement dispose que c’est à l’autorité compétente de l’État membre, et non à la Commission, qu’il incombe de décider, après consultation du notifiant concernant un produit génétiquement modifié, quelles informations doivent rester confidentielles.
(EN)Directive 2001/18/EC, on the deliberate release of genetically modified organisms (GMOs) into the environment, stipulates that it is the competent authority of the Member State, not the Commission, which decides, after consultation with the notifier of the GM product, which information in the notification should be kept confidential.

Bien que le protocole ne fournisse aucune indication sur ce point, il est clair qu'il vise à inclure tous les OGM destinés à être disséminés dans l'environnement, que ce soit immédiatement ou après un certain temps.
Although the Protocol gives no guidance as to this question, its intention is clearly to include all GMOs intended for release into the environment, whether immediately or after a delay.

La présente proposition de règlement représente après la directive remaniée sur la dissémination (2001/18/CE) un pas important en vue de régir le domaine des OGM au niveau communautaire.
Following the revised GMO Release Directive (2001/18/EC), the proposal for a regulation is an important step in regulating the GMO field at Community level.

1. Si une modification, intentionnelle ou non, de la dissémination volontaire d'un OGM ou d'une combinaison d'OGM peut avoir des conséquences du point de vue des risques pour la santé humaine et l'environnement après que l'autorité compétente a donné son autorisation écrite, ou si de nouveaux éléments d'information sur ces risques deviennent disponibles, soit pendant que l'autorité compétente d'un État membre examine la notification, soit après qu'elle a donné son autorisation écrite, le notifiant doit immédiatement:
1. In the event of any modification of, or unintended change to, the deliberate release of a GMO or of a combination of GMOs which could have consequences with regard to risks for human health and the environment after the competent authority has given its written consent, or if new information has become available on such risks, either while the notification is being examined by the competent authority of a Member State or after that authority has given its written consent, the notifier shall immediately:

—«effets différés» se réfère aux effets sur la santé humaine ou sur l'environnement qui ne sont pas observables au cours de la période de dissémination des OGM, mais qui deviennent apparents, en tant qu'effets directs ou indirects, soit à un stade ultérieur soit après la fin de la dissémination.
—‘delayed effects’ refers to effects on human health or the environment which may not be observed during the period of the release of the GMO, but become apparent as a direct or indirect effect either at a later stage or after termination of the release.

- "effets différés" se réfère aux effets sur la santé humaine ou sur l'environnement qui ne sont pas observables au cours de la période de dissémination des OGM, mais qui deviennent apparents, en tant qu'effets directs ou indirects, soit à un stade ultérieur soit après la fin de la dissémination.

Il est également nécessaire de fixer des objectifs communs pour la surveillance des OGM après leur dissémination volontaire ou leur mise sur le marché en tant que produits ou éléments de produits.
It is also necessary to establish common objectives for the monitoring of GMOs after their deliberate release or placing on the market as or in products.
