IN-CONTEXT TRANSLATIONS

Il est soutenu à cet égard que, dans la décision attaquée, en affirmant de manière lapidaire que l’erreur contenue dans le titre de la décision modificatrice du 31 décembre 2012 n’a eu aucun effet sur le contenu de la décision elle-même et sur la mise en œuvre du programme, la Commission n’aurait pas tenu compte de la l’importance du fait que les décisions relatives aux frais adoptées par la Région devaient être préalablement contrôlées par la Cour des comptes; que quatre mois se sont écoulés entre l’annonce de la correction et sa réalisation, sans qu’aucune explication ne soit fournie; que ceci a pu susciter le doute que la rectification à effectuer aurait été plus importante que celle annoncée comme se limitant au seul titre de la décision du 31 décembre 2012 et que la Cour des comptes a confirmé que l’action de la Région, qui s’est abstenue d’adopter les engagements avant de connaître officiellement le rectificatif (le 28 mars 2013), était correcte, laissant ainsi entendre que l’action inverse n’aurait pas été correcte.
The applicant claims in that regard that, in tersely confirming in the contested decision that the error in the title of the amending decision of 31 December 2012 had no effect on the content of the decision itself or on the implementation of the programme, the Commission neglected to take into consideration the relevance of the following circumstances: (i) the spending decisions adopted by the Region had to be checked beforehand by the Court of Auditors; (ii) four months had elapsed between the correction being announced and the correction being implemented, without any explanation being provided; (iii) that fact had the potential to arouse the suspicion that the correction to be made was of greater importance than a correction supposedly relating only to the title of the decision of 31 December 2012; and (iv) the Court of Auditors had confirmed that the course of action taken by the Region, which refrained from adopting the commitments until the correction was officially recognised (28 March 2013), was correct, thus giving it to be understood that the opposite course of action would not have been correct.

Annuls the corrigendum, published in the Official Journal of the European Union of 21 March 2013, to notice of open competition EPSO/AD/177/10 to constitute a reserve list from which to recruit administrators in the fields of European public administration, law, economics, audit and information and communication technology, and the corrigendum, published in the Official Journal of the European Union of 21 March 2013, to notice of open competition EPSO/AD/178/10 and corrigendum to notice of open competition EPSO/AD/179/10 to constitute a reserve list from which to recruit administrators in the fields of, respectively, librarianship and information science and audiovisual, in so far as their nature and content have been identified in paragraphs 68 to 70 of the present judgment;

D. considérant que l'accord politique dégagé le 27 juin 2013 au plus haut niveau politique entre le Parlement, la présidence du Conseil et la Commission sur le cadre financier pluriannuel pour la période 2014-2020 prévoit un engagement politique de la part du Conseil en vue de prendre toutes les mesures nécessaires pour garantir le plein respect des obligations de l'Union pour 2013, adopter officiellement le projet de budget rectificatif n° 2/2013 d'un montant de 7,3 milliards d'EUR, et adopter, sans tarder, un nouveau projet de budget rectificatif proposé par la Commission au début de l'automne afin d'éviter toute insuffisance de crédits de paiement justifiés;
D. whereas the political agreement reached on 27 June 2013 at the highest political level between Parliament, the Council Presidency and the Commission on the MFF for the period 2014-2020 included a political commitment from the Council to take all necessary steps to ensure that the Union's obligations for 2013 are fully honoured, to formally adopt Draft amending budget No 2/2013 for EUR 7,3 billion, as well as to adopt without delay a further draft amending budget to be proposed by the Commission in early autumn to avoid any shortfall in justified payment appropriations;

4. rappelle, cependant, la position qu'il a déjà défendue dans sa résolution du 13 mars 2013 sur le cadre financier pluriannuel, à savoir qu'il ne saurait y avoir de vote d'approbation du règlement CFP sans une garantie absolue du fait que les crédits de paiement non consommés pour 2013 seront intégralement pris en charge; attend dès lors du Conseil qu'il prenne une décision officielle concernant le projet de budget rectificatif 2/2013 pour un montant de 7,3 milliards EUR, au plus tard lors du Conseil Ecofin qui doit se tenir le 9 juillet 2013; demande instamment au Conseil de respecter son engagement politique d'adopter sans retard un autre budget rectificatif afin d'éviter toute insuffisance dans les crédits de paiement qui pourrait se traduire par un déficit structurel dans le budget de l'Union européenne à la fin de l'année 2013; affirme que le Parlement n'approuvera pas le nouveau règlement fixant le CFP ou n'adoptera pas le budget 2014 jusqu'à l'adoption, par le Conseil, dudit nouveau budget rectificatif, couvrant le déficit résiduel identifié par la Commission;

Reiterates, however, its position, as set out in its aforementioned resolution on the MFF of 13 March 2013, that the consent vote on the MFF Regulation cannot be granted unless there is an absolute guarantee that the outstanding payment claims for 2013 will be covered in full; expects the Council, therefore, to take a formal decision on Draft Amending Budget 2/2013 for an amount of EUR 7,3 billion, no later than the Ecofin Council to be held on 9 July 2013; insists that the Council stick to its political commitment to adopt without delay a further amending budget to avoid any shortfall in payment appropriations that could lead to a structural deficit in the EU budget at the end of 2013; states that Parliament will not give its consent to the MFF Regulation or will not adopt the Budget 2014 until this new amending budget, covering the remaining deficit as identified by the Commission, has been adopted by the Council;

In fact, whereas the Council’s position on Draft amending budget No 5/2010 covers modifications to OLAF’s establishment plan, without additional financial provisions, as well as the revision of the forecast for Traditional Own Resources (TOR, i.e. customs duties and sugar sector levies), VAT and GNI bases, the budgeting of the relevant UK corrections as well as their financing and revision of financing of GNI reductions in favour of the Netherlands and Sweden in 2010, resulting in a change in the distribution between Member States of their own-resources contributions to the EU budget, whereas the purpose of Draft amending budget No 5/2010 is to formally enter this budgetary adjustment into the 2010 budget, and whereas the Council adopted its position on 13 September 2010, we took note of Draft amending budget No 5/2010; and approved Council’s position on Draft amending budget No 5/2010 unamended and instructs its President to declare that Amending budget No x/2010 has been definitively adopted and to arrange for its publication in the Official Journal of the European Union.
